body WHEREAS, throughout the City of Newark construction and development affects the flow of storm water from properties to city streets, neighboring properties, and into the local watersheds; and

WHEREAS, Newark currently regulates storm water runoff management methods by way of Section 38:10-47, which requires new development to retain and delay the release of storm water by using various types of detention or retention methods; and

WHEREAS, the current regulations do not address the special needs of large sites, do not specify the types of detention or retention methods appropriate for unique situations, do not address future maintenance needs, and do not encourage the use of newer more highly sustainable methods; and

WHEREAS, the Newark Municipal Council had adopted Ordinance 6S&FA on May 16, 2007 with the intention of implementing new storm water management requirements, but that ordinance could not be implemented because of conflicts with other sections of the Municipal Code and because it did not adequately address Newark’s storm water management needs; and

WHEREAS, the City’s Division of Planning and Zoning, Department of Water and Sewer Utilities, Department of Engineering, and Sustainability Officer worked collaboratively using guidelines developed by the New Jersey Department of Environmental Protection to prepare a new, more appropriate set of regulations to replace the existing ones; and

WHEREAS, The Newark Central Planning Board reviewed these proposed regulations and adopted a Resolution on January 4, 2010 recommending that the Newark Municipal Council adopt this ordinance; and
