WHEREAS, Resolution 7R4-e (AS) adopted March 7, 2012, authorized the Director of the Department of Engineering to execute Contract #13-2011 Remediation and Demolition at Hayes Park East (608-630 Ferry Street), Newark, New Jersey 07105, with EQ Northeast, Inc., 185 Industrial Road, Wrentham, Massachusetts02093, for the total not to exceed amount of $1,243,187.00; and
WHEREAS, a ‘Notice to Proceed’ was issued dated May 21, 2012, specifying May 21, 2012 as the effective date and ending on May 20, 2013; and
WHEREAS, subsequent to the award of the contract, EQ Northeast, Inc. performed their contract obligations, finishing ahead of schedule (08/10/12); and
WHEREAS, due to a field change in contract performance, the total sum of the services invoiced or to be invoiced to the City of Newark was $36,907.51 less than the total sum of the contract that was awarded, thereby necessitating a change order to reduce the total sum of the contract from $1,243,187.00 to $1,206,279.49, as specified in Change Order #1 (“Attachment A”); and
