WHEREAS, on December 6, 2013, the City of Newark publicly advertised a Notice to Contractors Bid Advertisement for the construction of a Phase-III(C) Netting Facility at Freeman Street, located in the East Ward in the City of Newark, Contract No. 11-WS2004 (a copy of the advertisement is attached hereto and made a part hereof); and
WHEREAS, the Department of Water and Sewer Utilities distributed fifteen (15) bid packages to prospective vendors following the date of bid advertisement; and
WHEREAS, on January 7, 2014, seven (7) bids were received for the said project in accordance with the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, Montana Construction Corp. Inc., 80 Contant Avenue, Lodi, New Jersey 07644, submitted the lowest responsive and responsible bid according to the specifications, in the amount of $1,696,446.00 (a copy of the Bid Tabulation Sheet is attached hereto and made a part hereof); and
