WHEREAS, the Petitioner, Jorge Quirola, instituted suit in the Division of Workers Compensation of New Jersey, Essex County, bearing C.P. Number 2003-3442 against the City of Newark seeking workers' compensation benefits as a result of an accident that he sustained on January 7, 2003, while working for the Newark Department of Sanitation; and
WHEREAS, following settlement negotiations through Petitioner's attorney, Lester Goldblatt, Corporation Counsel and/or his designee, Chasan Leyner & Lamparello, P.C. ("Outside Counsel") have agreed to amicably resolve and settle this matter under Section 22 of the Workers Compensation Act (N.J.S.A. 34:15-22) for 100% permanent total disability orthopedic, neurologic and psychiatric in nature. The initial 450 weeks of the award will constitute a payment of Fifty One Thousand Six Hundred Thirty Four Dollars and Fifty Cents ($51,634.50). Pursuant to the terms of the Settlement Order to be executed by the Judge of the Division of Workers' Compensation, the City of Newark will also pay an attorney fee of Eighteen Thousand Five Hundred Eighty Eight Dollars and Zero Cents ($18,588.00), a medical evaluation fee of One Thousand Dollars and Zero Cents ($1,000.00) and a transcription fee of One Hundred Twenty Dollars ($120.00) for a total settlement of Seventy One Thousand Three Hundred Forty Two Dollars and Fifty Cents ($71,342.50); and petitioner will continue to receive benefits at the conclusion of the 450 weeks in accordance with N.J.S....
