WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2016 Municipal Aid Program ("NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal, and county roads and bridge projects; and
WHEREAS, on October 15, 2015, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to the NJDOT requesting grant funding in the amount of $1,855,707.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark, identified as application MA-2016-Street Resurfacing - Various Streets - 00619 for City of Newark, with no City funds required; and
WHEREAS, pursuant to Resolution 7R4-B, adopted December 2, 2015, the City of Newark Municipal Council ratified and authorized the actions taken by the Director of the Department of Engineering to submit an application for grant funding from the New Jersey Department of Transportation (NJDOT) Municipal Aid Program for improvements to various streets (10 locations) within the City of Newark; and
WHEREAS, as a result of the above application, the City of Newark received notice on March 28, 2016 (a copy of the NJDOT approval letter is attached hereto and made a part hereof) that it has been awarded a grant in the amount of $1,345,640.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark, with no City funds required; and
WHEREAS, the Department of Engineering wants to amend Resolution 7R4-B, adopted on December 2, 2015, to authorize the execution of an agreement with and accept grant funds in the amount of $1,345,640.00 from the NJDOT Municipal Aid Program, for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R4-B, adopted on December 2, 2015, is hereby amended and the Mayor and/or his designee, the Director of the Department of Engineering, are hereby ratified and authorized to accept the grant award in the amount of $1,345,640.00 from the New Jersey Department of Transportation (NJDOT) Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark (a copy of the NJDOT grant award approval letter is attached hereto and made a part hereof).
2. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby ratified and authorized to enter into and execute grant documents with the NJDOT to receive and expend the grant award in the amount of $1,345,640.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark.
3. No municipal funds are required for receipt or acceptance of this grant award.
4. The Director of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.

This resolution amends Resolution 7R4-B adopted December 2, 2015, and ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the grant award in the amount of $1,345,640.00 from the New Jersey Department of Transportation (NJDOT) Municipal Aid Program for Street Resurfacing - Various Streets - 2016 - Newark (10 Locations, MA-2016) within the City of Newark.
