WHEREAS, on September 2, 2015, the Municipal Council adopted Resolution 7R4-D ratifying and authorizing the Mayor and/or his designee, the Director of the Department of Engineering, to execute a Cost Reimbursement Agreement No. 2015-DT-BLA-201 between the City of Newark and the New Jersey Department of Transportation, to accept funds in the amount of $1,463,368.00 for the Broad Street (2 -Intersections FY-14), City of Newark, Essex County, STP-7628(103)CON Project (the "Project"); and
WHEREAS, on January 6, 2016, the New Jersey Department of Transportation (NJDOT) notified the City of Newark that it would receive an additional $1,199,475.00 in grant funding towards the construction of the Project, for a revised total grant in the amount of $2,662,843.00 ($2,505,107.00 for construction and $157,736.00 for inspection services); and
WHEREAS, the City of Newark wishes to amend Resolution 7R4-D, adopted on September 2, 2015, to authorize the Mayor and/or his designee, the Director of Engineering, to enter into and execute a new Cost Reimbursement Agreement No. 2015-DT-BLA-201, termed Federal Aid Agreement, in the form attached hereto, with the NJDOT, Division of Local Aid and Economic Development for a grant in the amount of $2,662,843.00, for the term of May 8, 2015 to May 8, 2018, to carry out the construction of the Project; and
WHEREAS, as part of the Cost Reimbursement Agreement No. 2015-DT-BLA-201, all allowable costs incurred for the performance of work in the attached Scope of Work in this Cost Reimbursement Agreement shall be eligible for reimbursement from the effective date of May 8, 2015, and all such work shall be completed by May 8, 2018 for the Broad Street (2 - Intersections FY-14), City of Newark, Essex County, STP-7628(103) CON; and
WHEREAS, the City of Newark wishes to appoint the Mayor and/or his designee, the Director of the Department of Engineering, to act as the authorized person to execute this task Order Agreement No. 2015-DT-BLA-201 to accept the funds provided in the amount of $2,662,843.00, for the Broad Street (2 - Intersections FY-14), City of Newark, Essex County, STP-7628(103)CON.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to execute Cost Reimbursement Agreement No. 2015-DT-BLA-201, in the form attached hereto, and to accept funds provided in the amount of $2,662,843.00 for the Broad Street (2-Intersections FY-14), City of Newark, Essex County, STP-7628(103)CON Project (the "Project") for the term of May 8, 2015 to May 8, 2018.
2. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark, to solicit proposals/receive bids to accomplish the objectives outlined in the Cost Reimbursement Agreement No. 2015-DT-BLA-201 for the Project.
3. The Municipal Council hereby ratifies this contract from May 8, 2015 until the date of adoption of this authorizing resolution.
4. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
5. The Director of Engineering shall file a fully-executed copy of the Cost Reimbursement Agreement No. 2015-DT-BLA-201 in the Office of the City Clerk.
6. No municipal funds are required for receipt or acceptance of this grant award.
STATEMENT
This resolution authorizes and ratifies the Mayor and/or his designee, the Director of the Department of Engineering, to amend Resolution 7R4-D, adopted on September 2, 2015, to enter into and execute a new Cost Reimbursement Agreement No. 2015-DT-BLA-201, with the New Jersey Department of Transportation, Division of Local Aid and Economic Development for a revised total grant in the amount of $2,662,843.00, for the Broad Street (2 - Intersections FY-14), City of Newark, Essex County, STP-7628(103)CON Project for the term of May 8, 2015 to May 8, 2018.
