Additional Information: 

Resolution 7R3-a(S) September 22, 2015 approved a grant agreement between the City of Newark and the National Fish and Wildlife Foundation to restore and enhance degraded wetlands.  The City of Newark wishes to enter into a contract with Matrix New World Engineering, Inc., to provide Professional Engineering Services in furtherance of the grant agreement.

WHEREAS, restoration of Newark Bay’s wetlands are needed to buffer against shoreline erosion, improve flood control and remove invasive plant life; and

 

WHEREAS, on or about January 31, 2014, on behalf of the City of Newark (“City” or “Newark”), the Deputy Mayor/Director of the Department of Economic and Housing Development, submitted an application to the National Fish and Wildlife Foundation (NFWF) seeking funding in the amount of $1, 560,000.000 to develop a comprehensive restoration design plan as well as funding to restore and enhance degraded wetlands and habitat on the City-owned parcel 910-964 Doremus Avenue near (Block 5078, Lot 91); and

 

WHEREAS, as a result of this application, NFWF awarded the City a grant in the amount of $1,560,000.00 to develop  a comprehensive restoration design plan as well as funding to restore and enhance degraded wetlands and habitat for the period commencing June 16, 2015 and terminating on June 15, 2017; and

 

WHEREAS, on May 28, 2015 the City executed a grant agreement with NFWF (“NFWF Grant Agreement”) for the City to receive the $1.56 million dollar grant from NFWF for the creation and restoration of Newark Bay’s wetlands at City-owned parcel 910-964 Doremus Avenue Rear (Block 5078, Lot 91-East Ward); and

 

WHEREAS, on September 22, 2015, 7R3-a(S), the Municipal Council approved the NFWF Grant Agreement, a copy of which is attached hereto as Exhibit A and made a part hereof, which agreement contains the terms and conditions upon which the grant is predicated; and

 

WHEREAS, on October 13, 2015 the Department of Economic and Housing Development solicited proposals for professional engineering services for the investigation, design and oversight of wetlands restoration for the Newark Bay Wetlands Restoration Project; and

 

WHEREAS, fifteen (15) proposals were picked up, and the Department of Economic and Housing Development received four (4) proposals by the November 5, 2015 submission deadline; and

 

WHEREAS, the above referenced proposals were reviewed, and a recommendation was made based upon the criteria contained in the Request for Proposals; and

 

WHEREAS, Matrix New World Engineering, Inc., (“Matrix”),  26 Columbia Turnpike, Florham Park, New Jersey, 07932, is recommended to the Municipal Council as the company that will provide the most successful approach to a project to restore Newark Bay’s wetlands, provide buffers against storm water surges, contribute to ecological diversity, and supports the economic development  efforts of the City through training and employment opportunities, in addition to providing superior knowledge of site specific conditions, technical expertise, and extensive experience; and

 

WHEREAS, the City wishes to enter into a contract with Matrix to provide Professional Engineering Services for the investigation, design, and oversight of restoration of Newark Bay’s wetlands at City-owned parcel 910-964 Doremus Avenue near (Block 5078, Lot 91), pursuant to the terms of the NFWF Grant Agreement and the City’s Request for Proposals for Professional Engineering Services, Newark Bay Wetlands Restoration Project; and

 

WHEREAS, this contract is being awarded pursuant to the Local Public Contracts Law (N.J.S.A. 40:11-1 et seq.) which authorizes contracts for "Professional Services"; and in accordance with N.J.S.A. 40A:11-5; and 

 

WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a Fair and Open Process pursuant to N.J.S.A. 19:44A-20, and is in compliance with Contractor Pay-to-Play Reform Ordinance, 6PSF-a August 1, 2012 ; and

 

WHEREAS, pursuant to N.J.A.C. 5:30- 5.4, a certificate evidencing the availability of funds has been provided and is attached hereto as Exhibit B.  

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, THAT:

 

1.                     The Mayor or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development is hereby authorized and directed, on behalf of the City of Newark, to enter into and execute a contract (the “Contract”) with Matrix New World Engineering, Inc., 26 Columbia Turnpike, Florham Park, New Jersey, 07932, to provide professional engineering services for the investigation, design and oversight of wetlands restoration for the Newark Bay Wetlands Restoration Project,  in an amount not to exceed $295,877.50 (Two Hundred Ninety-Five Thousand Eight Hundred Seventy-Seven Dollars and Fifty Cents).

 

2.                     The term of the Contract shall be 365 days from the issuance of a Notice to Proceed.

 

3.                     This Contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5) and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A.40A:11-5(1)(a)(i)), and Matrix has certified that it has not made or solicited a contribution in violation of the Contractor Pay-to-Play Reform Ordinance, 6PSF-a,  August 1, 2012.

 

4.                     A Certification of Funds from the Chief Financial Officer stating that there are sufficient and available funds for this purpose is attached hereto.

 

5.                     A copy of the executed Contract herein authorized shall be filed in the office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development and shall be made available for public inspection.

 

6.                     A notice of this action shall be published in the newspaper authorized by law to publish legal advertisements and as required by law within 10 days of the adoption of this resolution.

 

STATEMENT

 

                     This resolution hereby authorizes the Mayor and/or his designee to enter into and execute a contract on behalf of the City of Newark for professional engineering services with Matrix New World Engineering, Inc., at 26 Columbia Turnpike, Florham Park, New Jersey, 07932, to provide professional engineering services for the investigation, design and oversight of wetlands restoration for the Newark Bay Wetlands Restoration Project, in an amount not to exceed $295,877.50 (Two Hundred Ninety-Five Thousand Eight Hundred Seventy Seven Dollars and Fifty Cents), for the a period of 365 days from the issuance of a Notice to Proceed.
