Title

AN ORDINANCE AUTHORIZING TITLE 41“THE NEWARK ZONING AND LAND USE REGULATIONS” TO ADD THE DIETZE BUILDING, WHICH IS LOCATED AT 60-64 UNION STREET, BLOCK 185, LOT 68, AS A HISTORIC LANDMARK WITHIN THE CITY OF NEWARK, NEW JERSEY (EAST WARD).

                     WHEREAS, the Historic Preservation Element of the Master Plan of the City of Newark recognizes the importance of Historic Sites in the City; and

 

                     WHEREAS, any interested party may nominate a historic landmarks or district for local designation pursuant to the City of Newark revised general Ordinance, Title 41 Chapter 10; and

 

                     WHEREAS, in 1890, machinist Lewis H. Watson built, what is commonly known as “The Dietze Building,” which is located at 60-64 Union Street, Block 185, Lot 68 (between Ferry Street and Lafayette Street) in the Ironbound section of the City of Newark (the “Property”); and

 

                     WHEREAS, in 1927, the Property was damaged by fire, then acquired and reconstructed by the Dietze Realty Corporation with architect Charles F. Ackerman as the architect of record; and

 

                     WHEREAS, the Property appears today in similar condition as it was when it originally built in the 1890’s; and

 

                     WHEREAS, Anker West, Ceramics and Architecture (the “Applicant”) submitted an application to the Newark Landmarks and Historic Preservation Committee to consider designating the Property as a Historic Landmark within the City of Newark; and

 

                     WHEREAS, on July 16, 2014, the Applicant was heard by the Newark Landmarks and Historic Preservation Committee regarding the request to designate the Property as a Historic Landmark; and

 

                     WHEREAS, on July 16, 2014, the Newark Landmarks and Historic Preservation Committee approved of the request to designate the Property as a Historic Landmark and referred the matter to the Central Planning Board for its review and consideration; and

 

                     WHEREAS, on September 28, 2015, a public hearing was held by the Central Planning Board regarding the request to designate the Property as a Historic Landmark; and

 

                     

 

                     WHEREAS, after weighing the findings, expert testimony, and testimony of the public, the  Central Planning Board approved of the Historic Landmark designation for the Property and referred the matter to the Municipal Council of the City of Newark (the “Council”) for the Council’s review and consideration.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

Section 1.                      Department of Economic and Housing Development, Division of Planning and Community Development, Newark Zoning and Land Use Regulations, Title 41, Chapter 10, Section 28 of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, by adding the Dietze Building, located at 60-64 Union Street, Block 185, Lot 68 (East Ward) as a Historic Landmark in the City of Newark, New Jersey.

 

Section 2.                      All City ordinances or portions of ordinances inconsistent herewith are hereby repealed to the extent of their inconsistency only.

 

Section 3.                     If any part of this ordinance shall be declared to be invalid or inoperative, such part shall be deemed severable and the invalidity thereof shall not affect remaining parts of this Ordinance.

 

Section 4.                     This ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.

 

STATEMENT

 

This Ordinance adds the Dietze Building located at 60-64 Union Street, Block 185, Lot 68 as a Historic Landmark of the City of Newark, New Jersey (East Ward).
