Ordinance 6PSF-a(s) adopted on February 9, 2016 originally authorized and appropriated an amount not to exceed $16,000,000.00 - Energy Savings Improvement Program Refunding Bond.

 

Resolution 7R5-d adopted on March 2, 2016: Resolution providing for the issuance of ESIP Refunding Bonds in an amount not to exceed $16,000,000.00, for the purposes of financing the costs of the Energy Savings Improvement Program and providing the form, maturity and other details of said bonds.

WHEREAS, on December 22, 2015, the Newark Municipal Council authorized Resolution 7R4-a(s), that formally adopted the City of Newark Energy Savings Plan and approved the entering into an Energy Savings Services Contract (Phase II) with Honeywell International, Inc., (“Honeywell”), for the construction and implementation of recommended Energy Conservation Measures (“ECMs) for seventeen (17) Municipal Buildings/Facilities (“Facilities”); and

 

WHEREAS, the seventeen (17) facilities locations that have been identified are:

WHEREAS, on December 22, 2015  the City of Newark Municipal Council adopted Resolution 7R4-a(s), authorizing Phase II of the Energy Saving Contract for the construction and implementation of the recommended ECMs for the seventeen (17) Municipal Buildings,  in an amount not exceed Fourteen Million Nine Hundred Twenty-Six Thousand Three Hundred Sixty-Nine Dollars and Zero Cents ($14,926,369.00); and

 

WHEREAS, on April 26, 2016, in accordance with Local Bond Law, the Newark Municipal Council authorized Resolution 7R5-b(s/as), that amended Resolution 7R5-d adopted on March 2, 2016, which authorized the issuance of Energy Savings Improvement Program in an amount not to exceed Sixteen Million Dollars and Zero Cents ($16,000,000.00), for the purpose of financing the costs of acquisition and installation of energy savings improvements to be undertaken by the City (the "ESIP Refunding Bonds" or "Bonds"); and

 

WHEREAS, on May 11, 2016, the City issued Fifteen Million Five Hundred Eighty-Five Thousand Dollars and Zero Cents ($15,585,000.00) the principal amount of Bonds to finance the costs of acquiring and installing energy savings improvements in the buildings identified above; and

 

WHEREAS, the City seeks to ratify and confirm the approvals contained in Resolution 7R4-a(s) adopted on December 22, 2015, which approved a contract with Honeywell International, Inc., for services relating to the implementation of energy conservation measures in seventeen (17) Municipal Buildings.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The approvals contained in Resolution 7R4-a(s) adopted on December 22, 2015 with respect to a contract with Honeywell International, Inc., for services relating to the implementation of energy conservation measures in seventeen (17) Municipal Buildings are hereby ratified and confirmed.

2.                     Honeywell International Inc., shall be compensated for the Phase II construction and implementation of work from the proceeds of the Fifteen Million Five Hundred Eighty-Five Thousand Dollars and Zero Cents ($15,585,000.00) Energy Savings Improvement Program Refunding Bonds, issued by the City of Newark on May 11, 2016.

3.                     The remaining recitals and provisions of Resolution 7R4-a(s) adopted on December 22, 2015 shall remain in full force and effect.

4.                     There shall be no amendments to the Energy Savings Services Contract (Phase II) without the approval of the Municipal Council.

5.                     The Business Administrator and/ or Director of Engineering shall file a fully-executed copy of the contract and any supporting documents authorized herein with the Office of the City Clerk.

This resolution hereby ratifies and confirms the award of a contract with Honeywell International, Inc., for services relating to the implementation of energy conservation measures in seventeen (17) Municipal Buildings contained in Resolution 7R4-a(s) adopted on December 22, 2015.
