WHEREAS, Mr. Peter J. Cooney (Mr. Cooney) has been an employee of the City of Newark, (the City) as a Firefighter from July 29, 1996 through the present; and
WHEREAS, Mr. Cooney is an active member of the Police and Firemen's Retirement System (PFRS) and has 20 years and 4 months of PFRS Service Credit, meeting the minimum service requirement of at least 4 years for PFRS members; and
WHEREAS, the Director of the Department of Public Safety based upon the advice and documentation provided by Mr. Cooney's medical doctor, certifies that Mr. Cooney, due to an ongoing illness is totally and permanently disabled and no longer can perform his assigned duties (A copy of Ilya Kister, M.D.'s report is attached); and
WHEREAS, the City is unable to provide an alternative to the PFRS covered position with duties capable of being performed by Mr. Cooney; and
WHEREAS, the Public Safety Director has consented to the processing of the Involuntary Disability Retirement application.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Business Administrator, the Director of the Department of Public Safety and Director of Personnel are authorized to process an Involuntary Disability Retirement application for Mr. Peter J. Cooney.
