WHEREAS, the City of Newark wishes to enact and impose additional regulations for Hawkers and Peddlers concerning the operation and location of motor vehicles used by Hawkers and Peddlers on all streets located within the City of Newark, other than the Downtown District, in order to reduce congestion and enhance the safety of pedestrians and customers of Hawkers and Peddlers by requiring a separation of not less than two hundred (200) feet between any other Hawker and Peddler operating out of a motor vehicle.

 

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1.  Title VIII, Businesses and Occupations, Chapter 7, Hawking and Peddling; Canvassing and Soliciting, Section 8:7-6 is hereby amended to include the following additional prohibited conduct:

 

8:7-6 PROHIBITED CONDUCT.

 

No Peddler shall:

 

u.  Engage in the business of hawking or peddling with a motor vehicle along any street located within the City of Newark, other than the Downtown District, that is less than two hundred (200) feet from another Hawker or Peddler also operating its business out of a motor vehicle. 

 

Section 2.  Any Ordinances or parts thereof inconsistent with this Ordinance are hereby repealed.

 

Section 3.  This amendment to the Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.

 

STATEMENT

 

This Ordinance amends and supplements the Code of the City of Newark imposing additional regulations for Hawkers and Peddlers concerning the operation and location of motor vehicles used by Hawkers and Peddlers within areas in the City of Newark, other than the Downtown in order to reduce congestion and enhance the safety of pedestrian and customers of Hawkers and Peddlers by requiring a separation of two hundred (200) feet between any other Hawker or Peddler operating out of a motor vehicle.
