WHEREAS, at the request of the Department of Engineering and review of the traffic operations by New Jersey Transit in conjunction with the City of Newark, Division of Traffic and Signals, and pursuant to N.J.S.A. 39:4-197(3)(a), the following described location is relocated as a bus stop:
DELETE BUS STOP:
1. In the East Ward, along South Street, westbound on the northerly side thereof:
Pacific Street, far side
Beginning at the westerly curb line of Pacific Street, and extending 100ft westerly therefrom. (Pennington Court Apartments)
ADDED BUS STOP:
2. In the East Ward, along South Street, westbound on the northerly side thereof:
Pacific Street, near side
Beginning at the easterly curb line of Pacific Street, and extending 105ft easterly therefrom. (St. Justine’s Preschool II); and
WHEREAS, pursuant to Section 39:4-197(3)(a) of Title 39 of the Revised Statutes of New Jersey, a municipality may by ordinance, resolution or regulation designate or delete a bus stop; and
WHEREAS, pursuant to N.J.S.A. 39:4-8(e) a municipality may without the approval of the Commissioner, and consistent with the current standards prescribed by the Manual of Uniform Traffic Control Devices for Streets and Highways, by ordinance, resolution or regulation in any street under its jurisdiction designate stops.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. In the East Ward, the following described location is hereby relocated as a bus stop:
From: along South Street, westbound on the northerly side, at Pacific Street (far side), beginning at the westerly curb line of Pacific Street and extending 100ft westerly therefrom.
To: along South Street, westbound on the northerly side, at Pacific Street (nearside), beginning at the easterly curb line of Pacific Street and extending 105ft easterly therefrom.
2. No Municipal funds need to be expended for this act.
3. No Amendment will be made to this resolution without the approval of the Municipal Council of the City of Newark.
4. Upon approval, the Engineering Department will forward a copy of this resolution to the Office of the City Clerk to notify them of the Local Government’s approval for the relocation of a bus stop as stated.
5. Upon approval, a certified copy of this resolution shall be forwarded to New Jersey Transit to notify them of the Local Government’s approval for the relocation of a bus stop as stated.
6. Pursuant to N.J.S.A. 39:4-8 (e) of Title 39 of the Revised Statutes of New Jersey, the proposed bus stop relocation does not require New Jersey Department of Transportation’s approval.
