WHEREAS, the City of Newark, Department of Engineering, Division of Traffic and Signals, advertised for receipt of bids on January 31, 2017, for Contract No. 09-2015, Various Streets-2015 (12 Locations) MA-15 Newark Project; and
WHEREAS, on February 28, 2017, the Department received five (5) bids for Contract No. 09-2015, Various Streets-2015 (12 Locations) MA-15 Newark Project, in accordance with Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering, desires to accept the bid proposal submitted by the lowest responsible bidder, J.A. Alexander, Inc., 130 John F. Kennedy Drive North, Bloomfield, New Jersey 07003, and execute Contract No. 09-2015, Various Streets-2015 (12 Locations) MA-15 Newark Project with them, for an amount not to exceed $1,557,600.81.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, J.A. Alexander, Inc., 130 John F. Kennedy Drive North, Bloomfield, New Jersey 07003, and execute Contract No. 09-2015, Various Streets-2015 (12 Locations) MA-15 Newark Project with them, for the amount not to exceed $1,557,600.81.
2. Attached hereto are Certifications of Funds issued by the Director of Finance, City of Newark, which states (1) that there are available sufficient, legally appropriated funds in the amount of $1,557,600.81, for the purpose set forth hereinabove, and (2) the line appropriation of the official budget which shall be charged is as follows:

3. No amendment or modifications to this contract are allowed without prior Municipal Council approval.
4. The Director of the Department of Engineering shall file a fully executed copy of the contract and the Certifications of Funds in the Office of the City Clerk.

6. This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of the Department of Engineering. In accordance with N.J.S.A. 40A:11-12(9), the contract may be extended, subject to prior Municipal Council approval, for the period of time necessary for the completion of actual construction.
7. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et. seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
8. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, J.A. Alexander, Inc., 130 John F. Kennedy Drive North, Bloomfield, New Jersey 07003, and execute Contract No. 09-2015, Various Streets-2015 (12 Locations) MA-15 Newark Project, for an amount not to exceed $1,557,600.81, for a term of 365 consecutive calendar days from the issuance of the Notice to Proceed.
