WHEREAS, Abimbola Olawumi Oke was the owner of residential property, 513 Irvine Turner Boulevard, Newark, New Jersey 07108, also known as Block 2701, Lot 66.02 (the “Property); and
WHEREAS, on September 29, 2006 Abimbola Olawumi Oke died; and
WHEREAS, on or around December 29, 2006, Joseph Olabamiji Oke was issued Letters of Administration naming him the Administrator of the Estate of Abimbola Olawumi Oke; and
WHEREAS, on January 7, 2016, Joseph Olabamiji Oke, as the Administrator of the Estate of Abimbola Olawumi Oke, contracted with Coldwell Banker Residential to assist with the listing and sale of the Property; and
WHEREAS, on July 20, 2016, Joseph Olabamiji Oke, as the Administrator of the Estate of Abimbola Olawumi Oke, applied to the City of Newark, Division of Inspections and Enforcement, for an inspection of the Property for a Certificate of Code Compliance, Account No. 5412-L1, in furtherance of the sale; and
WHEREAS, as required by Newark Zoning and Land Use Regulations 40:18-2-4, on July 20, 2016, Pilar Zapatel Rodriguez administered payment on behalf of Joseph Olabamiji Oke, as the Administrator of the Estate of Abimbola Olawumi Oke, to the City of Newark, Division of Inspections and Enforcement, a fee in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00) to cover the costs of inspection for a Certificate of Code Compliance in furtherance of the sale of the Property; and
WHEREAS, Newark Zoning and Land Use Regulations 40:18-2-4 provides that the fees for inspection for Certificate of Code Compliance are not applicable to transfers of residential property by Administrators of estates; and
WHEREAS, because Joseph Olabamiji Oke is the Administrator of an estate and obtained the inspection for the Certificate of Code Compliance in furtherance of transferring the Property he was not required to pay the fee for the inspection; and
WHEREAS, a refund in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00) is now due to Pilar Zapatel Rodriguez on behalf of Joseph Olabamiji.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Director of the City of Newark Department of Finance is hereby authorized to issue a check to Joseph Olabamiji Oke, 513 Irvine Turner Boulevard, Newark, New Jersey 07108, in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00), to refund the fee paid for inspection of 513 Irvine Turner Boulevard, Newark, New Jersey 07108, for Certificate of Code Compliance as this fee was not applicable to transfers of residential property by Administrators of estates, pursuant to Newark Zoning and Land Use Regulations 40:18-2-4.
2. Attached hereto is a Certification of Funds issued by the Director of the Department Finance of the City of Newark, which states that there are available sufficient, legally appropriated funds in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00), for the purpose set forth herein above and which states that the line appropriation of the office budget which shall be charged is:

3. The original Resolution shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
STATEMENT
This resolution authorizes the Director of the Department of Finance, to issue a refund check in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00), to Joseph Olabamiji Oke, to refund the fee paid for inspection of 513 Irvine Turner Boulevard, Newark, New Jersey 07108, for Certificate of Code Compliance, as this fee was not applicable to transfers of residential property by Administrators of Estates, pursuant to Newark Zoning and Land Use Regulations 40:18-2-4.
