Extension of Emergency Contract #E2017-20 at no additional cost to the City of Newark

 WHEREAS, The Essex County Department of Engineering has provided the City of Newark, Department of Engineering (the “Department of Engineering”) with an inspection report for thirteen (13) Transit Bridges under the City’s jurisdiction with structural deficiencies at an estimated forty (40) locations of those thirteen (13) Bridges; and

 

WHEREAS, the Bridge’s Structural Deficiencies were labeled as Emergency, Priority I and Priority II in the inspection reports; and

 

WHEREAS, Structural Deficiencies were categorized and declared “Under Emergency” of six (6) bridges, passing over New Jersey Transit City Subway Tracks on Heller Parkway, Park Avenue, Central Avenue, Newark Street (2 Locations), and Haynes Avenue Bridge; and

 

WHEREAS, in the absence of a contract to remediate and abate the structural deficiencies of the six (6) bridges, the City’s Supervising Procurement Specialist, QPA, declared an emergency, at the request of the Director of the Department of Engineering regarding the structural remediation at the six (6) bridges. Emergency Contract E2017-20 was declared, dated September 21, 2017, in an amount not to exceed $173,000.00, for the period of September 19, 2017 through January 18, 2018, with Sparwick Contracting, Inc. (“Sparwick”), 18 Route 94, Lafayette, New Jersey 07848; and

 

WHEREAS, on October 5, 2017 the Department of Engineering issued a Notice to Proceed to Sparwick and the Bridge Emergency Repair Project commenced. The Notice to Proceed stated that the emergency repairs were to be completed no later than January 18, 2018; and

 

WHEREAS, the Department of Engineering received a letter from Sparwick, dated February 14, 2018, requesting an extension to complete the emergency bridge repairs until June 2, 2018, due to the delay in receiving Temporary Access Permits for repairing each bridge crossing the subway tracks from New Jersey Transit, extreme cold weather and excessive snow fall that has occurred this winter; and

 

WHEREAS, the Essex County Department of Engineering notified the Department of Engineering that the conditions at those six (6) bridges required abatement; and

 

                     WHEREAS, the Department of Engineering is currently in the process of going through the procurement process for a bridge repair contract and expects to award such a contract in April or May 2018; and

 

WHEREAS, it is imperative that the City of Newark permit Sparwick to complete the emergency bridge repairs to prevent any possible imminent hazards and to protect the health, safety, and welfare of the citizens of Newark; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-6, notwithstanding a good faith effort by the contracting unit to award a contract the need has arisen for a continued emergency contract with Sparwick to continue to remediate and abate the structural deficiencies of the six (6) bridges; and 

 

WHEREAS, by City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2(E)(1)(b)(c), states that Emergency Contracts shall not be for a period in excess of ninety (90) days and no extensions of emergency contracts shall be permitted without authorization by resolution of the Municipal Council; and

 

WHEREAS, in accordance with City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2(E)(1)(b)(c), the City of Newark, Department of Engineering seeks to extend emergency contract E2017-20 from January 19, 2018, through June 2, 2018, or until such earlier time as the emergency condition is abated, to complete the emergency repairs to six (6) bridges at no additional cost to the City.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Supervising Procurement Specialist, QPA, and/or the Director of the Department of Engineering, are hereby authorized to extend Emergency Contract E2017-20 with Sparwick Contracting, Inc., 18 Route 94, Lafayette, New Jersey 07484, for the emergency repairs of six (6) Bridges, at no additional cost to the City.  

 

2.                     This extension will allow the continuation of Emergency Contract E2017-20 for the emergency repairs of six (6) Bridges, for the period of January 19, 2018 through June 2, 2018, or until such earlier time as the emergency condition is abated.

 

3.                     The above-described extension of Emergency Contract E2017-20 extension is ratified from January 19, 2018 to the date of adoption of this authorizing resolution. 

 

4.                     No additional funds are required for the above-described extension period.

 

5.                     The Supervising Procurement Specialist, QPA, for the City of Newark shall file a copy of Emergency Contract E2017-20 attached hereto with the Office of the City Clerk.

 

6.                     If required by the State Law, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

STATEMENT

 

This resolution hereby ratifies and authorizes the Mayor and/or his designee, the Supervising Procurement Specialist and/or the Director of the Department of Engineering to extend Emergency Contract E2017-20 with Sparwick Contracting, Inc., 18 Route 94, Lafayette, New Jersey 07848, for the emergency repairs of six (6) Bridges under the City’s jurisdiction, from January 19, 2018 through June 2, 2018, or until such earlier time as the emergency condition is abated at no additional cost.
