WHEREAS, the City of Newark advertised Contract 12-WS2016 Replacement of Water Distribution Mains located at various locations in the City of Newark, on January 31, 2018; and
WHEREAS, the Department of Water and Sewer Utilities ("Department") distributed sixteen (16) bid packages to prospective vendors following the date of bid advertisement; and
WHEREAS, on March 2, 2018, the Department received five (5) bids for said project in accordance with the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, the Department of Water and Sewer Utilities reviewed the bids, and two (2) bids were rejected as non-responsive to the bid specifications, due to the omission of certain mandatory state required certification forms, and to the City of Newark's Affirmative Action Program and the Minority Business Enterprise/Women Business Enterprise (MBE/WBE) utilization requirements as this requirement is a material condition of the bid that cannot be cured or waived, and three (3) bids were rejecte...
