The total grant from the NJDEP is $158,531.10, for which the City of Newark shall receive $12,813.78 to carry out the above purpose.

WHEREAS, the City of Newark has identified the need to undergo a comprehensive planning approach to identify and address vulnerabilities to increased flood risk, advance regional resilience, and protect environmental resources; and

WHEREAS, the City of Newark is eligible for New Jersey Department of Environmental Protection (NJDEP) Resilient NJ Planning Program funds as a member of the Regional Team comprised of Hudson County, the City of Hoboken, the City of Jersey City, the City of Newark, the City of Bayonne, HOPES, and Ironbound Community Corporation; and

WHEREAS, the coastal and riverine environment in this region leaves the four participating municipalities particularly susceptible to flood-related hazards and the region was one of the most severely impacted areas of the state when Hurricane Sandy made landfall in 2012; and

WHEREAS, the City of Newark is also eligible for NJDEP Resilient NJ Planning Grant Program funds as one of the municipalities in the nine Sandy-impacted counties as identified by HUD; and

WHEREAS, on May 21, 2018 the NJDEP published a Notice of Grant Fund Availability for a competitive grant from the Resilient NJ Planning Grant Program to provide funding to develop and implement up to 5 regional plans to build resilience to future flooding events; and

WHEREAS, on July 20, 2018 the City of Jersey City as the "Prime" City leading the aforementioned Regional Team submitted a joint application to the NJDEP for NJDEP Resilient NJ Planning Grant Program funds requesting One Hundred and Fifty-Eight Thousand Five Hundred Thirty-One Dollars and Ten Cents ($158,531.10) to work collaboratively with Regional Team members and multidisciplinary consulting experts engaged by NJDEP to help the Regional Team identify important community assets, assess vulnerability to future flooding along the coast and from rivers, identify actions to reduce flood risk, evaluate these options using a detailed cost-benefit analysis, and develop regional resilience and adaptation action plans; and

WHEREAS, the City of Newark will serve as a "Regional Team Member" and support the efforts of the City of Jersey City in its role of coordinating activities of the Regional Team, and

WHEREAS, the City of Newark budget proposal of Twelve Thousand Eight Hundred and Thirteen Dollars and Seventy-Eight Cents ($12,813.78) that was part of the joint application submitted to the NJDEP by the Prime was accepted in full; and

WHEREAS, the NJDEP has requested that all Regional Team Members, including the City of Newark, to execute a resolution of local commitment authorizing them to enter into the grant agreement; and

WHEREAS, the NJDEP has requested that all Regional Team Members, including the City of Newark, adopt a Citizen Participation Plan to provide for citizen participation opportunities required by CDBG-DR regulations as applicable for this project.


NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Municipal Council hereby ratifies and authorizes the City of Newark to join in the application submitted by the City of Jersey City to the New Jersey Department of Environmental Protection for NJDEP Resilient NJ Planning Grant Program funds from the date of application submission, July 20, 2018, to the date of adoption of this authorizing resolution.

2. The City of Newark's portion of the grant award from the NJDEP Resilient NJ Planning Grant Program in the amount of Twelve Thousand Eight Hundred and Thirteen Dollars and Seventy-Eight Cents ($12,813.78) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

3. The Mayor and/or his designee, the Business Administrator, is authorized to enter into and execute a grant agreement with the New Jersey Department of Environmental Protection, Office of Costal and Land Use Planning, PO Box 420, Mail Code 401-07B, Trenton, New Jersey 08625-0420 and further authorizes the expenditure of funds pursuant to the terms of the grant agreement entered into by the City of Jersey City, as Prime and NJDEP.

4. No municipal funds are required for receipt or acceptance of this grant award.

5. The Business Administrator shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement to receive and expend grant funding in the Office of the City Clerk.

BE IT FURTHER RESOLVED, that the City of Newark will attend and participate at project meetings and events as a member of the Regional Team; and

BE IT FURTHER RESOLVED, that the City of Newark will support the efforts of City of Jersey City in its role of coordinating activities of the Regional Team; and

BE IT FURTHER RESOLVED, that the City of Newark will provide timesheets, receipts for expenses, and required documentation to the Prime, when requested, in order to be reimbursed for staff time and expenses for participation at project meetings and events; and

BE IT FURTHER RESOLVED, that the City of Newark will engage in outreach efforts; and

BE IT FURTHER RESOLVED, that the City of Newark will assist in the identification of socially vulnerable populations and will work towards addressing their unique needs within the planning process; and

BE IT FURTHER RESOLVED, that the City of Newark will provide data and information as requested; and

BE IT FURTHER RESOLVED, that the City of Newark will work with the Prime in
identifying potential resilience projects and initiatives; and
BE IT FURTHER RESOLVED, that the City of Newark will support the Prime in providing meeting space, and resources; and
BE IT FURTHER RESOLVED, that the City of Newark will review and provide feedback on interim and final deliverables; and

BE IT FURTHER RESOLVED, that the City of Newark will work with the Consultant Team provided by NJDEP in its efforts to complete the project; and

BE IT FURTHER RESOLVED, that the City of Newark will continue participation until the completion of this program; and

BE IT FURTHER RESOLVED, that the City of Newark agrees to adopt, in full, the State of New Jersey Department of Community Affairs "CITIZEN PARTICIPATION PLAN, CDBG-DISASTER RECOVERY" March 12, 2013 (CDBG-DR Citizen Participation Plan) in order to provide citizen participation opportunities required by CDBG-DR regulations as applicable for this project; and

BE IT FURTHER RESOLVED, that the City of Newark agrees to comply with all CDBG-DR regulations, and accepts that the proposed use(s) of CDBG-DR funds are not reimbursable by FEMA, SBA or other federal agencies.


STATEMENT

This resolution ratifies and authorizes the actions taken by the City of Newark to join in the application submitted by the City of Jersey City for grant funding from the New Jersey Department of Environmental Protection NJDEP, in the amount of One Hundred and Fifty-Eight Thousand Five Hundred Thirty-One Dollars and Ten Cents ($158,531.10) for the development and implementation of a Regional Resilience and Adaptation Action Plan in collaboration with a regional team comprised of the City of Newark in Essex County; cities of Bayonne, Hoboken, and Jersey City in Hudson County; and non-profit partners Ironbound Community Corporation and HOPES, with no City funds required, and furthermore, authorizes the Mayor and/or his designee, the Business Administrator, to enter into and execute a grant agreement with and accept grant funds in the amount of $12,813.78 (Twelve Thousand Eight Hundred and Thirteen Dollars and Seventy-Eight Cents) from NJDEP to carry out the above purposes, for a two year period commencing on the official start date to be determined by the NJDEP. No municipal funds are required.
