WHEREAS, the City of Newark (the “City”) wishes to provide technical radiology services including, but not limited to x-rays, mammographies, and ultrasounds for patients of the Mary Eliza Mahoney Health Centers; and
WHEREAS, University Hospital (“UH”) is a State-controlled entity of the State of New Jersey, which provides technical radiology services including but not limited to x-rays, mammographies, and ultrasounds; and
WHEREAS, the City and UH wishes to enter into a contract for these technical radiology services; and
WHEREAS, this is a no bid contract awarded without competitive bidding, as an exception to Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), the contract between the City and UH, an agency of the State of New Jersey, is not subject to the Pay-to-Play legislation; and
WHEREAS, the City of Newark adopted the Contractor Pay-to-Play Reform Ordinance, codified at Section 2:4-22C of the Revised General Ordinances of Newark (hereinafter “Pay-to-Play Reform Ordinance”), which requires reporting of political contributions to candidates for City of Newark elective municipal offices or City of Newark or County of Essex political committees and prohibits certain political contributions during the duration of the contract; and
WHEREAS, reporting requirements, pursuant to N.J.S.A. 19:44A-20.5 et seq. and the Pay-to-Play Reform Ordinance, are only applicable to business entities, as defined therein, and as an instrumentality of the State of New Jersey, University Hospital is therefore not required to submit certain disclosure statements.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to enter into and execute a contract on behalf of the City of Newark (“City”) with University Hospital (“UH”), 150 Bergen Street, Newark, New Jersey 07103, to provide technical radiology services including but not limited to x-rays, mammographies, and ultrasounds for patients of the Mary Eliza Mahoney Health Centers for the period commencing on May 14, 2018 and terminating on May 13, 2020, in an amount not exceed One Hundred Eighty Thousand Dollars and Zero Cents ($180,000.00).
2. The contract is hereby ratified from May 14, 2018 to the date of adoption of this authorizing resolution.
3. This contract is awarded without competitive bidding as an exception to Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), in that the contract is between the City and UH, an instrumentality of the State of New Jersey, and is not subject to the Pay-to-Play legislation.
4. This contract is in compliance with the City’s Pay-to-Play Reform Ordinance.
5. Pursuant to N.J.A.C. 5:30-5.5(a), attached hereto is a partial Certification of Funds in the amount of Forty-Eight Thousand Seven Hundred Fifty Dollars and Zero Cents ($48,750.00) from the Chief Financial Officer, which shall be charged to account code line NW026-46540-B2018. The balance of funds will be certified from the 2019 budget.
6. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to enter into and execute a contract with University Hospital, 150 Bergen Street, Newark, New Jersey 07103, to provide technical radiology services for patients of the Mary Eliza Mahoney Health Centers, for the period commencing on May 14, 2018 and terminating on May 13, 2020, in an amount not to exceed One Hundred Eighty Thousand Dollars and Zero Cents ($180,000.00).
