The First Amendment to increase the contract amount by $6,139.13 for a total contract amount not to exceed $1,161,536.13.

WHEREAS, the City of Newark desires to continue to act as the Grantee/Sub-Grantor for disbursement of funds made available by the United States Department of Housing and Urban Development (HUD), Housing Opportunities for Persons with AIDS (HOPWA) Program, to provide housing assistance and supportive services for persons living with HIV/AIDS through sub-recipient contracts within the Newark Eligible Metropolitan Statistical Area (NEMSA), which consists of Essex, Hunterdon, Morris, Somerset, Sussex, and Union Counties in New Jersey and Pike County, Pennsylvania; and

 

WHEREAS, the City of Newark, by Resolution 7R5-C, adopted on March 15, 2017, awarded a contract to the AIDS Resource Foundation for Children to provide housing assistance and supportive services for persons living with HIV/AIDS in the City of Newark for the contract period January 1, 2017 through December 31, 2017; and

 

WHEREAS, the funds to cover the contract were fully expended during the contract term; and

 

WHEREAS, the AIDS Resource Foundation for Children continued to provide housing assistance and supportive services for persons living with HIV/AIDS in the City of Newark, which requires an increase of the total contract amount; and

 

WHEREAS, the AIDS Resource Foundation for Children represents to the City of Newark that at least an additional Six Thousand One Hundred Thirty-Nine Dollars and Thirteen Cents ($6,139.13) is necessary to continue to provide housing assistance and supportive services through December 31, 2017; and

 

WHEREAS, the increase of an additional Six Thousand One Hundred Thirty-Nine Dollars and Thirteen Cents ($6,139.13) brings the total contract to an amount not to exceed One Million One Hundred Sixty-One Thousand Five Hundred Thirty-Six Dollars and Thirteen Cents ($1,161,536.13).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are authorized on behalf of the City of Newark, to enter into and execute the First Amendment to the Housing Opportunities for Persons with AIDS (HOPWA) Sub-Recipient Agreement with AIDS Resource Foundation for Children, at 77 Academy Street, Newark, New Jersey 07102, to provide housing assistance and supportive services for persons living with HIV/AIDS in the City of Newark through December 31, 2017, for an additional Six Thousand One Hundred Thirty-Nine Dollars and Thirteen Cents ($6,139.13), for a contract total amount not to exceed One Million One Hundred Sixty-One Thousand Five Hundred Thirty-Six Dollars and Thirteen Cents ($1,161,536.13).

 

2.                     The Municipal Council ratifies this First Amendment to the HOPWA Sub-Recipient Agreement to provide housing assistance and supportive services for persons living with HIV/AIDS in the City of Newark from January 1, 2017 to the date of adoption of this authorizing resolution.

 

3.                     All other terms and conditions of the contract shall remain the same.

 

4.                     Attached hereto is a Certification of Funds in the amount of Six Thousand One Hundred Thirty-Nine Dollars and Thirteen Cents ($6,139.13) from the Municipal Comptroller that there are sufficient funds, for the purpose set forth hereinabove, from Account Code Line: NW051-G18-2H6M0-A-72030-B2016.

 

5.                     A duly executed copy of said contract shall be forthwith filed in the Office of the City Clerk by the Director of the Department of Health and Community Wellness.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Health and Community Wellness, to enter into and execute the First Amendment to the Housing Opportunities for Persons with AIDS (HOPWA) Sub-Recipient Agreement with AIDS Resource Foundation for Children, at 77 Academy Street, Newark, New Jersey 07102, utilizing HOPWA funding to provide housing assistance and supportive services for persons living with HIV/AIDS in the City of Newark for an additional Six Thousand One Hundred Thirty-Nine Dollars and Thirteen Cents ($6,139.13), for a contract total amount not to exceed One Million One Hundred Sixty-One Thousand Five Hundred Thirty-Six Dollars and Thirteen Cents ($1,161,536.13), from January 1, 2017 through December 31, 2017.
