Additional Information:
The contract amount will not exceed $125,000.00 for the month of August, and $115,000.00 per month for September 1, 2019 through December 31, 2019. This extension is necessary to continue the care, impoundment and sheltering of animals in Newark until a concrete plan is developed and implemented.

WHEREAS, the Department of Health and Community Wellness entered into Emergency Contract #E2019-07 for impoundment and sheltering services with Associated Humane Societies Inc. for the period May 2, 2019 through July 31, 2019 at a cost not to exceed Three Hundred Sixty Thousand Dollars and Zero Cents ($360,000.00); and
WHEREAS, the City of Newark is exploring options on various alternatives to improving animal control services in Newark; and
WHEREAS, the Department of Health and Community Wellness continues to be in immediate and emergent need for impoundment and sheltering services for residents of Newark from August 1, 2019 through December 31, 2019; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and
WHEREAS, the Department of Health and Community Wellness desires to extend Emergency Contract #E2019-07 for a per month amount of One Hundred Twenty-Five Thousand Dollars and Zero Cents ($125,000.00) for the period of August 1, 2019 through August 31, 2019 and One Hundred Fifteen Thousand Dollars and Zero Cents ($115,000.00) for the period of September 1, 2019 through December 31, 2019, for a total amount not to exceed Five Hundred Eighty-Five Thousand Dollars and Zero Cents ($585,000.00); and
WHEREAS, N.J.A.C. 5:34-6.1(a)(3) provides that the emergency purchasing procedure may be used when the need for such goods or services has arisen notwithstanding a good faith effort on the part of a municipality to plan for the purchase of any goods or services required by the municipality; and
WHEREAS, the services of Associated Humane Societies Inc. to the City of Newark is essential to the protection of the health, safety and welfare of the citizens and residents of Newark and the animals therein; and
WHEREAS, it is a matter of public health, safety and welfare that the above-described emergency contract be extended because the City of Newark still needs to ensure the care, impoundment and sheltering of animals within Newark; and
WHEREAS, City Ordinance 6PSF-e, adopted on April 6, 2011, Article 2:5-13.2(e)(1)(c) provides that no extension of an emergency contract shall be permitted without authorization by the Municipal Council by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Purchasing Agent, are authorized to extend Emergency Contract #E2019-07 for a per month amount of One Hundred Twenty-Five Thousand Dollars and Zero Cents ($125,000.00) for the period of August 1, 2019 through August 31, 2019 and One Hundred Fifteen Thousand Dollars and Zero Cents ($115,000.00) for the period of September 1, 2019 through December 31, 2019 for a total amount not to exceed Five Hundred Eighty-Five Thousand Dollars and Zero Cents ($585,000.00).
2. This extension will allow for the continuation of impoundment and sheltering services in the City of Newark.
3. The extension of Emergency Contract #E2019-07 is ratified from August 1, 2019 to the date of adoption of this authorizing resolution.
4. Pursuant to N.J.A.C. 5:30-5.5, Temporary Budget, attached hereto is a partial Certification of Funds from the Director of Finance, in the amount of Five Hundred and Sixty Thousand Dollars and Zero Cents ($560,000.00) and the line appropriation of the official budget which shall be charged is Business Unit NW011; Dept. ID 200; Division/Project 2001; Account # 95920, Budget Ref: B 2019. The balance of funds will be certified from the 2019 adopted budget.
5. The Purchasing Agent shall file a copy of Emergency Contract #E2019-07 with the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.S.J.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7,2008.
