WHEREAS, the Department of Public Safety, Police Division's operations often times requires entrance upon and use of private property in order to effectively carry out its police powers, duties and responsibilities to protect the general public; and
WHEREAS, property owner(s) may request that the City execute a release, indemnification, hold harmless agreement prior to allowing the use of its property for planned police activity; and
WHEREAS, in the interest of public safety and the safety of the police officers, the Corporation Counsel deems information concerning this release, indemnification and hold harmless agreement to be confidential and shall not be shared with or provided to the general public; and
WHEREAS, the Director of the Department of Public Safety seeks the support of the Municipal Council for the issuance of a confidential release, hold harmless and indemnification(s) for the benefit of property owners when requested by a property owner; and
WHEREAS, due to its confidential nature a copy of the executed release, indemnification and hold harmless agreement will be filed with the City Clerk under seal by the Director of Public Safety.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
