WHEREAS, the Department of Public Safety, Office of Emergency Management (the "City") is committed to providing efficient and effective Citizens' Emergency Alert System to the City of Newark and its citizens; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(dd), a contract for proprietary computer software may be awarded as an exception to public bidding as the provision or performance of goods or services is for the support and/or maintenance of proprietary computer hardware and/or software; and
WHEREAS, the City would like to contract with Rave Wireless, Inc., (hereinafter "Rave Wireless"), 492 Old Connecticut Path, Framingham, Massachusetts 01701, to maintain the efficient and effective Citizens' Emergency Alert System to the City of Newark and its citizens; and
