WHEREAS, ShopRite/Glass Gardens, Incorporated (hereinafter “ShopRite”) located at 244 West Passaic Street, Rochelle Park, New Jersey 07662, wishes to provide a donation to the Department of Public Works, in support of the Clean Community Slam Dunk the Junk event for 2025; and

 

WHEREAS, ShopRite, a volunteer network, wishes to donate to the City of Newark (the “City”), Department of Public Works (“DPW”), One Thousand Dollars and Zero Cents ($1,000.00), in support of the Clean Community Slam Dunk the Junk event for 2025; and

 

WHEREAS, pursuant to Local Public Contracts Law N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use, which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

WHEREAS, ShopRite is donating $1,000.00 in support of the Clean Community Slam Dunk the Junk event for 2025 at no cost to the City (see Gift Letter attached hereto); and

 

WHEREAS, ShopRite fully understands and agrees it is not entitled to receive any direct benefit from the City of Newark or from any of its officers or employees in exchange for its gift; and

 

WHEREAS, pursuant to N.J.S.A. 40A: 5-29, the DPW desires to accept the gift of $1,000.00

 

                     

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council authorizes the Director of the Department of Public Works(“Director”), on behalf of the City of Newark, to accept the gift from Shoprite, located at 244 West Passaic Street, Rochelle Park, New Jersey 07662, of One Thousand Dollars and Zero Cents ($1,000.00) in support of the Clean Community Slam Dunk the Junk event for 2025 to the Department of Public Works.

 

2.                     Pursuant to N.J.S.A. 40A:5-15, the Director shall relinquish said gift to the Chief Financial Officer within forty-eight (48) hours of the receipt thereof; and

 

3.                     The City acknowledges the generous donation through this resolution. 

 

4.                     No municipal funds shall be expended for the acceptance of this gift.

 

5.                      The Director shall file a copy of the gift letter in the Office of the City Clerk.

 

6.                            The acceptance of the gift is ratified from on or about October 15, 2025 to the date of adoption of this authorizing Resolution.

 

 

STATEMENT

                     This resolution ratifies and authorizes the Director of the Department of Public Works, on behalf of the City of Newark, to accept the gift of $1,000.00 in support of Clean Community Slam Dunk the Junk event for 2025 to the Department of Public Works from ShopRite, 244 West Passaic Street, Rochelle Park, New Jersey 07662.  This gift is at no cost to the City of Newark.
