AN ORDINANCE AMENDING TITLE 8, CHAPTER 12 HOURS OF OPERATION (8:12-6A, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK NEW JERSEY, AS AMENDED AND SUPPLEMENTED (Restaurants)

WHEREAS, the Newark, Municipal Council wishes to amend the regulations which govern the hours of operations for restaurants within the City of Newark.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 2. Title 8, Chapter 12, Section 6A, HOURS OF OPERATION, of the Revised Ordinances of the City of Newark, County of Essex, New Jersey, shall be amended as follows:
8:12-6A. HOURS OF OPERATION.
a. All restaurants (that are not defined herein as a drive-in or drive thru restaurant), and Retail Sales and Retail Service Establishments, as defined herein, and located on streets as set foth herein shall not conduct business during the hours of 10:00 P.M. and 6:00 A.M., Sunday through Thursday and 11:00 P.M. and 6:00 A.M. on Friday and Saturday. Such businesses located within the
boundaries of the Improvement District listed below are exempt from the application of this ordinance.
Newark Downtown Special Improvement District (map attached)
Ironbound Business Improvement District (map attached)
Mt. Prospect Avenue Neighborhood Special Improvement District (map attached)
This provision of this ordinance shall be applicable in any and all Special Improvement Districts that might be created in the future.
b. The restriction upon business hours imposed by subsection (a) shall not apply to pharmacies or holders of plenary retail distribution licenses under the Alcohol Beverage Law, N.J.S.A. 33:1-1 et seq; except that the holders of such licenses may not conduct any business between the hours of 11:00 p.m. and 5:00 a.m. other than as permitted by N.J.S.A. 33:1-40.3 and other applicable City Ordinances.

STATEMENT
This Ordinance Amends- Title 8, Chapter 12, Section 6A Hours of Operation of the Revised
Ordinances of the City of Newark, County of Essex, New Jersey
