WHEREAS, Resolution 7R1-a was adopted by the Municipal Council on November 15, 2021, which authorized the Mayor and the Business Administrator to submit a 2021 One-Year Action Plan for Program Year 2021-2022 (September 1, 2021 through August 31, 2022) to the United States Department of Housing and Urban Development (HUD), which contained, among other items, a request for $7,526,667.00 in CDBG funding, $624,893.00 in ESG funding, $2,739,395.00 in HOME funding, and $5,768,156.00 in HOPWA funding; and
WHEREAS, Resolution 7R1-a, adopted on November 15, 2021, by the Municipal Council, also authorized the acceptance of said grant funds and the execution of grant documents and agreements with HUD to receive said grant funds; and
WHEREAS, the American Rescue Plan Act (HOME-ARP) of 2021 appropriated $5 billion to provide housing, services, and shelter to individuals experiencing homelessness and other vulnerable populations to be allocated by formula to jurisdictions that qualified for HUD HOME Investment Partnerships Program (HOME) allocations in Fiscal Year 2021; and
WHEREAS, on April 28, 2021, the City of Newark (“City”) was informed of its allocation of $9,928,468.00 from the HOME-ARP funding for HUD HOME; and
WHEREAS, the City desires to further address its homelessness assistance needs by obtaining these funds as an additional resource to provide housing, services, and shelter to individuals experiencing homelessness and other vulnerable populations; and
WHEREAS, on November 30, 2022, the City’s Business Administrator signed and submitted the HOME-ARP Allocation Plan to HUD as a substantial amendment to the City’s fiscal year 2021 Annual Action Plan for HUD review and acceptance that included the supplemental formula allocation of $9,928,468.00 to the City from the HOME-ARP funding; and
WHEREAS, by an award letter dated February 17, 2023, HUD approved the City’s aforesaid Substantial Amendment (a copy of said award letter is attached hereto and made a part hereof) for a total of $9,928,468.00; and
WHEREAS, the Mayor and the Business Administrator wish to accept the additional HOME-ARP funding and execute a grant agreement governing the supplemental program award in the amount of $9,928,468.00; and
WHEREAS, no matching Municipal funds are required for acceptance of the additional HOME-ARP funding; and
WHEREAS, no commitment of City resources or staff is required for acceptance of the additional HOME-ARP funding.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, are hereby authorized to submit a Substantial Amendment of the City of Newark’s (“City”) 2015-2020 United States Department of Housing and Urban Development (HUD) Consolidated Plan by submitting a Substantial Amendment of the City’s 2021 Annual Action Plan, proposing an American Rescue Plan amendment that includes a supplemental formula allocation of $9,928,468.00 to the City from American Rescue Plan (HOME-ARP) for its HUD HOME Investment Partnerships Program (HOME).
2. The Municipal Council hereby ratifies its authorization of the submission of the Substantial Amendment of the City’s 2015-2020 HUD Consolidated Plan by submitting a Substantial Amendment to the City’s 2021 Annual Action Plan from the date of its submission to the date of adoption of this authorizing resolution.
3. The above-described HOME-ARP funding from HUD, that includes a supplemental formula allocation to the City in the additional amount of $9,928,468.00 in HOME funding is hereby accepted (copy of the award letter dated February 17, 2023 is attached hereto and made a part hereof).
4. The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute such grant documents and agreements with HUD, as may be necessary to receive the above-described grant funds.
5. The Municipal Council hereby ratifies its authorization of the execution of the grant documents and agreements from the date of their execution to the date of adoption of this authorizing resolution.
6. No Municipal funds are required for the receipt or acceptance of the grant funds.
7. No commitment of City resources or staff is required for the receipt or acceptance of the grant funds.
8. The Business Administrator shall file fully-executed copies of the Substantial Amendment of the City’s 2015-2020 HUD Consolidated Plan by way of the Substantial Amendment to the City’s 2021 Annual Action Plan, grant award letter, any grant agreement amendments and any associated grant documents or agreements in the Office of the City Clerk.
STATEMENT
This Resolution amends, ratifies and authorizes the actions taken by the Mayor and/or his designee, the Business Administrator, to submit a Substantial Amendment of the City’s 2015-2020 HUD Consolidated Plan by submitting a Substantial Amendment to the City’s 2021 Annual Action Plan, proposing an American Rescue Plan Amendment, that includes a supplemental formula allocation to the City of Newark in the amount of $9,928,468.00 in HOME Investment Partnerships Program funding, and further ratifies and authorizes the execution of the grant agreements necessary to receive the grant funds in the amount of $9,928,468.00, and further authorizes the acceptance of the grant funds.
