Resolution 7R12-e adopted on August 7, 2024 awarded a contract in an amount not to exceed $588,723.00 for a period of (120) calendar days from the date of the written Notice to Proceed to final completion.
Change Order #1 will not change the contract amount, but will increase the contract period by (196) calendar days for a new completion period of (316) calendar days to August 29, 2025.

WHEREAS, 7R12-e adopted on August 7, 2024, the Director of the Department of Water and Sewer Utilities to execute Contract 15-WS2024, Repair of Timberbrook Road and Culvert, with Hutton Construction, LLC (“Hutton”), 41 Village Park Road, Cedar Grove, New Jersey 07009, in the amount of $588,723.00 for a period of 120 calendar days from the date of the written Notice to Proceed, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq; and
WHEREAS, the Notice to Proceed for the repair of Timberbrook Road and the culvert was issued to Hutton on October 17, 2024 and the contract stipulates that the project completion date is 120 calendar days, with the anticipated completion date being February 14, 2025; and
WHEREAS, the project site is governed by the New Jersey Department of Environmental Protection (NJDEP) permit, which includes specific timing restrictions designed to protect wildlife habitats; and
Whereas, in accordance with the NJDEP permit, site work for this project cannot commence until April 1, 2025 in order to comply with wildlife preservation guidelines and the project team acknowledges these restrictions and will ensure that work begins no earlier than April 1, 2025 fully adhering to the conditions set forth in the NJDEP permit to protect local wildlife and the environment; and
Whereas, an additional 196 calendar days is required for the final completion of this project, extending the original timeline to accommodate the necessary work and ensure successful project delivery from the date of the issuance of a written Notice to Proceed; and
WHEREAS, the Department of Water and Sewer Utilities wishes to enter into and execute a Contract Change Order #1 to Contract 15-WS2024, Repair of Timberbrook Road and Culvert with Hutton extending the contract period by 196 calendar days for a new completion period of 316 calendar days to August 29, 2025 with no change to contract amount.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Contract Change Order #1 to Contract 15-WS2024, Repair of Timberbrook Road and Culvert with Hutton Construction, LLC. 41 Village Park Road, Cedar Grove, New Jersey 07009 extending the contract completion period by 196 calendar days for a new completion period of 316 calendar days to August 29, 2025 with no change in the contract amount of $588,723.00.
2. This Change Order is ratified from the date of the Contract Modification Proposal and Acceptance (Change Order #1) to the date of this authorizing Resolution.
3. A fully executed copy of the Change Order #1 shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities and with the New Jersey Department of Environmental Protection (NJDEP) by the Director of the Department of Water and Sewer Utilities.
STATEMENT
This Resolution ratifies, amends and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Contract Change Order #1 to Contract 15-WS2024, Repair of Timberbrook Road and Culvert with Hutton Construction, LLC., 41 Village Park Road, Cedar Grove, New Jersey 07009, extending the contract period by 196 calendar days for a new completion period of 316 calendar days to August 29, 2025 with no change in the contract amount of $588,723.00.
