This Resolution will rescind the Original Resolution and contract award to Untied Sales USA Corp., due to the inability to honor the bid proposal submitted on November 18, 2021.

WHEREAS, Resolution 7R1-e adopted on October 30, 2022, by the Municipal Council authorized the Purchasing Agent, QPA (the “QPA”), to enter into and execute a contract with 1.) Colonial Hardware Corporation, 33 Commerce Street, Springfield, New Jersey 07081; 2.) United Sales USA Corp., 185 30th, Street, Brooklyn, New York 11232 to provide First Aid Kits and Refills for various Departments in the City of Newark for an amount not to exceed One Hundred Forty- Eight Thousand Dollars and Zero Cents ($148,000.00), for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15; and
WHEREAS, on August 18, 2023, United Sales USA Corp, notified the Division of Central Purchasing that their company could no longer honor the prices submitted in the November 18, 2021 bid proposal as their costs have increased in the last two years; said notice is made a part hereof; and
WHEREAS, the City of Newark wishes to amend Resolution 7R1-e adopted on October 5, 2022, by rescinding the award with United Sales USA Corp., 185 30th Street, Brooklyn, New York 11232 effective August 18th, 2023.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark hereby amends Resolution #7R1-e adopted on October 5th, 2023 by rescinding the contract award to United Sales USA Corp., 185 30th Street, Brooklyn, New York 11232 due to the inability to honor the prices submitted in the bid proposal dated November 18, 2021, as their costs have increased in the last two years.
2. Any authority to enter into and execute a contract pursuant thereto is null and void.

This Resolution Amends Resolution #7R1-e adopted on October 5, 2022,
By rescinding the contract award to United Sales USA Corp., 185 30th Street, Brooklyn, New York 11232, to provide First Aid kits and Refills. United Sales USA Corp., can no longer honor the prices submitted in the bid proposal dated November 18, 2021, as their costs have increased in the last two years.
