WHEREAS, the City of Newark seeks to achieve measurable progress in reducing waste at the neighborhood level and diverting waste for productive purposes which may include organic waste processing, recycling initiatives and responsible disposal of hazardous materials; and
 
WHEREAS, through Resolution 7R3-e adopted on January 6, 2010, the Municipal Council authorized the  Department of Economic and Housing Development to apply for and accept grant funding from the U.S. Department of Energy ("DOE") Energy Efficiency and Conservation Block Grant ("EECBG") program as a part of the American Recovery Reinvestment Act of 2009 (ARRA) in the amount of $2,836,300.00 for activities including sub-grants to community organizations for Green Neighborhood Pilot projects for which purpose up to $567,000.00 in EECBG funds may be allocated; and
 
WHEREAS, through a competitive bidding process the City advertised a Request for Proposals for Newark-based non-profit organizations to support the creation of a Green Neighborhood Pilot Program in Waste Diversion, and of the six (6) qualified respondents, Urban Renewal Corporation, located at 224 Sussex Avenue, Newark, NJ 07103, submitted the proposal considered by a review committee to be one of the best and most responsive, taking into account factors such as potential health impact of removal of electronic waste, success with e-waste recycling, and staff qualifications; and
 
WHEREAS, Urban Renewal Corp will develop a Green Neighborhood Pilot Program that focuses on e-waste diversion at the neighborhood level, providing pick-up at target locations and ensuring responsible disposal of materials, as well as assist, as budget permits, with the development of outreach materials to educate residents, businesses, and institutions in target neighborhoods about e-waste disposal, the cost of which services will not exceed $18,804.00; and
 
WHEREAS, this Grant Agreement is being awarded in accordance with the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, the Local Public Contracts Law N.J.S.A. 40A:11-1, et seq. and is in compliance with the Newark Executive Order MEO-07-0001, effective March 31, 2007 and the provisions of the American Reinvestment Recovery Act of 2009, Public law 111-5 (ARRA). All activities funded under this contract must comply with the rules and regulations of ARRA, including, as applicable, Buy American Act, 41 U.S.C. §§ 10(a) - 10(d) Davis-Bacon Act, 40 U.S.C. §3141, the National Environmental Policy Act (NEPA), 42 U.S.C. §4321 and Waste Stream rules and regulations; and
 
WHEREAS this project will be supported exclusively from grant funds accepted by the City through Resolution 7R3-e adopted on January 6, 2010; and
 
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.  
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Deputy Mayor/Director of Economic and Housing Development, are hereby authorized to enter into and execute the attached Grant Agreement with Urban Renewal Corp., located at 224 Sussex Avenue, Newark, NJ 07103, in an amount not to exceed $18,804.00 for development of a Green Neighborhood Pilot Program that focuses on e-waste diversion services in target neighborhoods throughout the City of Newark using EECBG funds from the U.S. Department of Energy.
    1. The Grant Agreement shall be for a period commencing on the date of approval of this Resolution by the Municipal Council and terminating eight months thereafter or August 15, 2012, whichever comes first.
    1. This Grant Agreement is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, the Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and is in compliance with the Newark Executive Order MEO-07-0001, effective March 31, 2007 and the provisions of the American Reinvestment Recovery Act of 2009, Public law 111-5 (ARRA). This resolution authorizes the Mayor and/or his designee, the Deputy Mayor/Director of Economic and Housing Development, to enter into and execute a Grant Agreement with Urban Renewal Corp., located at 224 Sussex Avenue, Newark, NJ 07103, in an amount not to exceed $18,804.00 in EECBG funds from the U.S. Department of Energy to provide for development of a Green Neighborhood Pilot Program that focuses on e-waste diversion services in target neighborhoods for the period commencing on the date of approval of this Resolution by the Municipal Council  and terminating eight months thereafter or August 15, 2012, whichever comes first.
