      WHEREAS, the City of Newark advertised a Request for Qualifications (RFQ) for System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System and the proposals were received on January 18, 2012, with Scubel, LLC, located at 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey 08816, found to be in the best interest of the City of Newark to accept; and
      
      WHEREAS, it is the intention of the Administration through the Office of Management and Budget (OMB) to execute the contract with Scubel LLC to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System, in the amount not to exceed $1,400,000.00, for the period commencing  April 7, 2012  and terminating on April 6, 2013; and
 
      WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a fair and open contract pursuant to the State Pay-to-Play Law N.J.S.A. 19:44A-20.5; and
 
 
WHEREAS, pursuant to the Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd)), such a contract is essential for the provision or performance of goods or services for System Support, Maintenance and Enhancement for an existing proprietary Licensed Oracle/Peoplesoft Enterprise System; and
 
      
 
      WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract; and
 
      WHEREAS, the Director of Finance has certified the partial availability of funds in the amount of $200,000.00 with a certification of funds from: Fund 011, Department 200, Division 2001, Account 96700, Budget Reference 2012, is attached hereto.
 
      
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Business Administrator and/or the Director of the Office of Management and Budget are hereby authorized to enter into a contract with Scubel LLC, located at 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey  08816, to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System Implementation for the City of Newark, in an amount not to exceed $1,400,000.00, for the period commencing  April 7, 2012  and terminating on April 6, 2013, with an option to renew and/or extend the contract for an additional term not to exceed one (1) year, subject to approval and authorization by the Newark Municipal Council.
    3. The Municipal Council hereby ratifies its authorization of a contract between the City of Newark and Scubel, LLC, for the period commencing April 7, 2012 through the date of adoption of this authorizing resolution.
    5. Attached hereto is a partial Certification of Funds in the amount of $200,000.00 from Fund 011, Department 200, Division 2001, Account 96700, Budget Reference 2012, which states that there are available legally appropriated funds for the purpose set forth hereinabove. Additional funds are contingent upon appropriation as required by N.J.A.C. 5:30-5.5(c) and pursuant to N.J.A.C 5:30-5.5(d) (2).  The Comptroller's Certification shall be filed along with the original resolution in the Office of the City Clerk.
    1. This contract is being awarded pursuant to the fair and open procedures of the State Pay-To-Play Law (N.J.S.A 19:44A-20.5) and pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd), as it is for System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System for the City of Newark and is in compliance with Newark Executive Order MEO-07-0001, effective March 31, 2007.
 
    1. There shall be no amendments or changes to this contract without approval of the Newark Municipal Council.
    2. There shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16.
    3. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of the Office of Management and Budget.
    1. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
    3. If required by State Law, the City Clerk shall provide the appropriate notice of award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
 
 
 
 
 
 
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Director of the Office of Management and Budget (OMB)  to enter into a contract with Scubel LLC, located at 197 State Route 18 South, Suite 3000, East Brunswick, New Jersey 08816, to provide System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System Implementation for the City of Newark, in an amount not to exceed $1,400,000.00, commencing  April 7, 2012  and terminating on April 6, 2013, with an option to renew and/or extend the contract for an additional term of one (1) year, subject to approval and authorization by the Newark Municipal Council. This contract is being awarded pursuant to the fair and open procedures of the State Pay-To-Play Law (N.J.S.A 19:44A-20.5) and pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-5 (1) (dd), as it is for System Support, Maintenance and Enhancement for an existing Licensed Oracle/Peoplesoft Enterprise System Implementation for the City of Newark and is in compliance with Newark Executive Order MEO-07-0001, effective March 31, 2007.
