Additional Information: 

This resolution authorizes the City’s Department of Public Safety to utilize the New Jersey Cooperative Purchasing Alliance (“Bergen County Cooperative”) Contract #BC-BID-24-43 Cars, Crossovers, Class 1-3 Pickup Trucks, Chassis, SUVs and Vans-COOP to purchase police vehicles for the Police Department.

 WHEREAS, on December 15, 2021, the Municipal Council of the City of Newark adopted Resolution 7R1-d authorizing the City of Newark’s (“City’s”) membership in the New Jersey Cooperative Purchasing Alliance (“Bergen County Cooperative”), One Bergen County Plaza, 3rd Floor Hackensack, New Jersey 07601, a New Jersey State approved cooperative purchasing system; and

 

WHEREAS, the Bergen County Cooperative maintains competitively awarded master contracts through which its members can make advantageous purchases; and

 

WHEREAS, said cooperative pricing system was developed for the purpose of utilizing the competitive bidding process to make public procurement more efficient and provide cost savings to its members; and

 

WHEREAS, the City’s membership in the system is active and continuous; and

 

WHEREAS, the Department of Public Safety has requested to utilize Bergen County Cooperative Contract # BC-BID-24-43 (Cars, Crossovers, Class 1-3 Pickup Trucks, Chassis, SUVs and Vans) to purchase vehicles for the Newark Police Division from All American Ford of Paramus, 375 Route 17 Paramus, NJ 07652, an authorized Bergen County Cooperative vendor at a cost not to exceed One Million Four Hundred Thousand Dollars and Zero Cents ($1,400,000.00), for the period commencing upon approval of this resolution through June 18, 2026, inclusive of any extensions granted by Bergen County Cooperative; and

 

WHEREAS, the City’s Purchasing Agent does not object to said request.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent, are authorized to utilize New Jersey Cooperative Purchasing Alliance (“Bergen County Cooperative) Contract # BC-BID-24-43 to purchase police vehicles for the Newark Police Division from All American Ford of Paramus, 375 Route 17 Paramus, New Jersey 07652, an authorized Bergen County Cooperative vendor. Said purchases are authorized for the period commencing upon approval of this resolution through June 18, 2026, inclusive of any contract extensions authorized by the Bergen County Cooperative. Said purchases shall not exceed One Million Four Hundred Thousand Dollars and Zero Cents ($1,400,000.00).

 

2.                     All purchase orders and related documentation shall be in accordance with the relevant Bergen County Cooperative Contract, including the Standard Terms and Conditions, Method of Operation and Third-Party Agreement, if applicable, as contained in the Bergen County Cooperative # BC-BID-24-43 Cars, Crossovers, Class 1-3 Pickup Trucks, Chassis, SUVs and Vans-COOP contract.

 

3.                     Attached hereto is the Chief Financial Officer’s partial certification of funds, which states that partial funds in the amount of Six Hundred Twelve Thousand Four Hundred Twenty-Two Dollars and Zero Cents ($612,422.00) are available in the Temporary Budget for the contract authorized by this Resolution. The line appropriation which shall be charged is as follows: Business Unit NW026 Account No. 46155 Budget Ref. 2025. A written certification of funds shall be prepared for funds to be expended beyond the temporary budget period and in 2026. Said certification(s) shall be filed together with this Resolution in the Office of the City Clerk. Continuation of the contract beyond the temporary budget period and in budget year 2026 shall be subject to the availability and appropriation of sufficient funds. There shall be no advance payment on this contract, in accordance with N.J.S.A. 40A:5-16.

 

5.                     This contract complies with New Jersey Local Unit Pay-to-Play Law (N.J.S.A. 19:44A-20.4 et seq.) and as a contract award resulting from a competitive bidding process, constitutes an award pursuant to a fair and open process.

 

6.                     The Division of Central Purchasing shall file duly executed copies of contracts, including purchase orders, in the Office of the City Clerk.

 

7.                     If required by State law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller no later than twenty (20) business days following such award in accordance with N.J.S.A. 52:15C-10 and various Notices of the Office of the State.

 

STATEMENT

 

This Resolution authorizes the Mayor and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent to purchase vehicles, such as Ford Expedition, Explorer and Transit for the Newark Police Department from authorized Bergen County Cooperative vendor All American Ford of Paramus 375 Route 17 Paramus, New Jersey 07652. Purchases are authorized for the period commencing upon approval of this Resolution through June 18, 2026, inclusive of any contract extensions granted by Bergen County Cooperative, at a cost not to exceed One Million Four Hundred Thousand Dollars and Zero Cents ($1,400,000.00).
