WHEREAS, the Department of Child and Family Well-Being of the City of Newark has a need to better prepare parents and caregivers to recognize signs and symptoms of alcohol, tobacco and other drug use; and
 
 
WHEREAS, the City of Newark wishes to enter into a contract with Essex Prevention Resources, Inc., located at 201 Bloomfield Avenue, Verona, New Jersey 07044, to provide evidence-based programs to promote substance abuse prevention and recovery education through teen leadership development and adult training, in the amount of $60,000.00, for the period of January 1, 2011 through December 31, 2011; and
 
WHEREAS, the Local Public Contracts Law (N.J.S.A.40A:11-1) requires that the resolution authorizing the award of a contract for "Professional Service" without competitive bidding must be published in a local newspaper; and
 
WHEREAS, Essex Prevention Resources, Inc., has submitted evidence-based programs that meet the funders requirements; and
 
WHEREAS, this contract has been determined and certified in writing to have a value in excess of $17,500.00, and is being awarded as a non-fair and open contract pursuant to N.J.S.A.19:44A-20.5 et seq.; and
 
WHEREAS, the contract shall be awarded as an open-ended contract for an amount not to exceed $60,000.00; and
 
WHEREAS, Essex Prevention Resources, Inc., (hereinafter referred to as EPR or Vendor) has completed and submitted a Business Entity Disclosure Certification which certifies that Essex Prevention Resources, Inc., has not made any reportable contributions to a political or candidate committee in the previous year, and that the contract will prohibit Essex Prevention Resources, Inc., from making any reportable contributions through the term of this contract; and
 
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay to Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the  Director of the Department of Child and Family Well-Being are hereby authorized and directed on behalf of the City of Newark to execute and enter into a contract with Essex Prevention Resources, Inc., located at 201 Bloomfield Avenue, Verona, New Jersey 07044, to provide evidence-based programs to promote substance abuse prevention and recovery education through teen leadership development and adult training  in the amount of $60,000.00 for the period of January 1, 2011 through December 31, 2011.
 
2.      The contract between the City of Newark and Essex Prevention Resource, Inc. is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
 
3.      Attached hereto is a certification of the City of Newark, which states that there are available legally appropriated funds for the purpose set forth hereinabove from FUND 051, DEPT G11, ACCOUNT 71280, BUDREF B2011. .
 
4.      This contract is being awarded pursuant to the non-fair and open procedures of the Pay-to-Play Law N.J.S.A. 19:44A-20.5 et seq., and the City of Newark Executive Order on Pay to Play Reform, MEO-07-0001 and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(a)(i) because these services are to be rendered by a person (or persons) whose performance requires knowledge of an advance type in a field of learning acquired by a prolonged formal course of specialized instruction and study, as distinguished from general academic instruction, N.J.S.A.40A:11-5(1)(a)(i).
 
5.      The contract will contain language prohibiting any contributions in violation of any state or local law.
 
6.      A copy of the Business Disclosure Entity Certification and the Determination of Value is placed on file with this resolution.
 
7.      The Director of the Department of Child and Family Well-Being shall file a fully executed copy of the contract in the Office of the City Clerk.
 
8.      A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
 
STATEMENT:
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Child and Family Well-Being to enter into a professional services contract between the City of Newark and Essex Prevention Resources, Inc., located at 201 Bloomfield Avenue, Verona, New Jersey 07044, to provide evidence-based program to promote substance abuse prevention and recovery education through teen leadership development and adult training in an amount not to exceed $60,000.00, for the period of January 1, 2011 through December 31, 2011.
