WHEREAS, on April 19, 2011, the City of Newark through its Purchasing Director advertised to solicit bids for contractor(s) to provide a Robot, Dragon Runner, or Equal to the Fire Department as per the attached bid proposal; and
WHEREAS, the Division of Central Purchasing distributed four (4) bid packages to prospective bidders following the date of advertisement; and
WHEREAS, on May 12, 2011, two (2) responses were received to this advertisement; and
WHEREAS, one (1) vendor responded to say the company did not have any products meeting the City's specifications; and
WHEREAS, the Fire Director recommends after review, that an award be made to the only responsive responsible bidder, QinetiQ North America, Inc.; and
WHEREAS, the Purchasing Director concurs with the recommendation; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the vendor agreed to hold the prices for consideration beyond sixty (60) days; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq., meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Purchasing Director are hereby authorized to enter into contract with QinetiQ North America, Inc., 350 Second Ave. Waltham, MA 02451 to provide a ROBOT, DRAGON RUNNER, OR EQUAL (TALON ROBOT), to the City of Newark, whose bid was received on the advertised due date and determined to be the only responsive responsible bidder in accordance with bid specifications. The term of the contract will be established as upon delivery, not to exceed July 31, 2012.
2. There shall be no amendment or change of this contract without the approval of the Municipal Council.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16.
4. Funds for the Department of Fire's usage are encumbered under FUND NW051 •DEPT G10 •PROJ- A10D0 •ACCT 94550 • BUDREF- B2010.
5. It is the responsibility of the Director of Fire to ascertain that the equipment received is in compliance with the specifications.
6. The Purchasing Director shall forthwith file a duly executed copy of the contract in the Office of the City Clerk.
7. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT OF INTENT:
This contract is awarded to QinetiQ North America, Inc., to provide a Dragon Runner Robot, or Equal (Talon Robot), at a total cost of $191,633.00, upon complete delivery, not to exceed July 31, 2012.
