WHEREAS, the City of Newark is in need to Pump Out, Haul and Dispose Of Sludge from the Lagoon at the Pequannock Water Treatment Plant, West Milford, New Jersey, to provide capacity necessary to the Sludge Lagoon for the operation of the City of Newark's water utility system; and
WHEREAS, on May 22, 2013 a Notice of Violation was issued by Water Compliance and Enforcement Division of the New Jersey Department of Environmental Protection (NJDEP) to the Newark Watershed Conservation and Development Corporation (NWCDC) to take corrective measures within 30 days to achieve compliance by providing capacity to the Sludge Lagoon for storage of residuals; and
WHEREAS, pursuant to the public bidding process of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., the Department of Water and Sewer Utilities advertised on May 29, 2013, in a general circulation newspaper, for the receipt of sealed bids from bidders to Pump Out, Haul and Dispose Of u Sludge from the Lagoon at the Pequannock Water Treatment Plant, West Milford, New Jersey, in accordance with bid specifications; and
WHEREAS, ten (10) prospective bidders requested Bid Specifications from the Department of Water and Sewer Utilities; and
WHEREAS, on June 12, 2013, the Department of Water and Sewer Utilities received sealed bids from five (5) contractors for said bid; and
WHEREAS, the bids were reviewed by the Department of Water and Sewer Utilities and found that the objectives of competitive bidding were achieved, that favorable bid prices were received, and that in accordance with N.J.S.A. 40A:11-1 et seq., the bid submitted by Accurate Waste Removal Services Inc., 226 Prospect Point Road, Lake Hopatcong, New Jersey 07849, is the lowest responsible bid in accordance with the bid specifications; and
WHEREAS, the City of Newark desires to award a contract to Accurate Waste Removal Services Inc., 226 Prospect Point Road, Lake Hopatcong, New Jersey 07849, in the amounts specified in the Bid to Pump Out, Haul and Dispose Of up to 2,000,000 gallons of Sludge from the Lagoon at the Pequannock Water Treatment Plant for an amount not to exceed $218,000.00, for the period of one (1) year from Notice to Proceed; and
WHEREAS, the award of this contract is necessary for the efficient operation of the City of Newark Pequannock Water Treatment Plant and is in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and the fair and open process described in the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, is hereby authorized to enter into a contract with Accurate Waste Removal Services Inc., 226 Prospect Point Road, Lake Hopatcong, New Jersey 07849 to Pump Out, Haul and Dispose Of Sludge from the Lagoon at the Pequannock Water Treatment Plant in accordance with bid specifications for a total amount not to exceed $218,000.00, for a term of one (1) year from Notice to Proceed.
2. There shall be no amendment or change to the contracts without approval by the Newark Municipal Council.
3. There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
4. The Acting Director of the Department of Water and Sewer Utilities shall forthwith file a fully executed copy of the contract in the Office of the City Clerk.
5. The Department of Water and Sewer Utilities has determined that funds will be available and will be allocated in the 2013 Budget of the Department of Water and Sewer Utilities and included in a line item for the award of this contract and this contract shall be subject to that appropriation. There will be no expenditure of funds authorized until a certification of funds is obtained and a copy filed with the City Clerk.
6. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, to enter into contract with Accurate Waste Removal Services Inc., 226 Prospect Point Road, Lake Hopatcong, New Jersey 07849 to Pump Out, Haul and Dispose Of Sludge from the Lagoon at the Pequannock Water Treatment Plant, in accordance with bid specifications, for a total amount not to exceed $218,000.00, for a term of one (1) year from Notice to Proceed.
