WHERAS, the City of Newark (“the City”) desires to offer a series of diverse events collectively known as “2015 Community Arts and Culture Entertainment Series” by providing entertainment activities and events beginning July 1, 2015 through December 31, 2015 for the residents of the City regardless of ethnicity, religion, gender, or age; and

 

                           WHEREAS, the City desires to engage a professional and highly qualified community-oriented organization to provide said services; and

 

                     WHEREAS, the Newark Arts Council submitted a proposal to provide such services to the Mayor’s Office of Arts, Cultural Development, and Tourism; and

 

WHEREAS, the Newark Arts Council has extensive experience and creativity necessary to conceptualize and provide the City of Newark with the opportunity to promote, maintain and enrich the lives of its residents via its rich heritage steeped in varied musical stylings through its concert series; and

 

WHEREAS, the Newark Arts Council is a collection of community-oriented professionals capable of providing the creative judgment and coordination skills necessary to assist in producing a multi-faceted series of programs that will also be informative and educational for all residents of the City Newark; and 

 

WHEREAS, the Newark Arts Council will provide the City and Newark residents, regardless of their age, religion, gender, or ethnicity high quality programming, that fully captures the extraordinary diversity of the programming required for these arts and entertainment events; and

 

 

                           WHEREAS, the City desires to engage Newark Arts Council to provide services for the entertainment activities, events and related goods and services associated with the Newark Entertainment Series; and

 

                           WHEREAS, the Newark Arts Council has represented itself as qualified by virtue of its experience to provide the required services in the manner and on the terms and conditions set forth herein; and

 

WHEREAS, pursuant to the Local Public Contracts Law N.J.S.A. 40A:11-5(1)(a)(i) such a contract for performance of goods and/or services that are original and creative in character in a recognizable field or artistic endeavor may be awarded as an exception to public bidding; and

 

WHEREAS, the award of this contract is not subject to Pay-to-Play laws as the contract is being awarded to the Newark Arts Council, a non-profit entity N.J.S.A 19:44A-20.26; and

 

WHEREAS, the value of this contract will not exceed One Hundred Thirty- One Thousand Five Hundred Dollars and Zero Cents ($131,500.00); and

 

WHEREAS, Newark Arts Council will receive a professional service fee of ten (10) percent of the contract gross budget which is not to exceed One Hundred Thirty-One Thousand Five Hundred Dollars and Zero Cents ($131,500.00); and

 

 

WHEREAS, the Director of Neighborhood and Recreational Services in collaboration with the Executive Director of the Mayor’s Office of Arts, Cultural Development and Tourism believe it is in the best interests of the City of Newark to engage the services of Newark Arts Council to assist with the presentation of the “Newark Entertainment Series,” by providing entertainment activities, related events and goods and services related thereto.  

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director Neighborhood and Recreational Services in collaboration with the Executive Director of the Mayor’s Office of Arts, Cultural Development and Tourism are authorized to enter into and execute a contract with Newark Arts Council to provide professional services for the presentation of “2015 Community Arts and Culture Entertainment Series” including, entertainment activities, events associated with the Newark Entertainment Series 2015 and such other related goods and services, for an amount not to exceed One Hundred Thirty-One Thousand Five Hundred Dollars and Zero Cents ($131,500.00), for the period commencing on July 1, 2015 and terminating on December 31, 2015.

 

 

2.                     Attached hereto is the Comptroller’s  Partial Certification of funds which states the funds in the amount of fifty thousand dollars and no cents ($50,000.00) are available from the line appropriation  of the official budget which shall be charged is (Place line budget reference here).

 

3.                     Newark Arts Council will receive a professional service fee of ten (10) percent of the contract gross budget which is not to exceed One Hundred Thirty-One Thousand Five Hundred Dollars and Zero Cents ($131,500.00).

 

4.                     There shall be no amendments to the contract without Municipal Council approval. 

 

5.                     There shall be no advance payments made against this contract in accordance with N.J.S.A.40A:5-16.

 

6.                     The Director of Neighborhood and Recreational Services shall file a fully executed copy of contract with the Office of the City Clerk.

 

7.                     Notice of this action shall be published in the newspaper authorized to publish legal advertisements and as required by law within ten (10) days of the date of adoption.   

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Neighborhood and Recreational Services, in collaboration with Executive Director of the Mayor’s Office of Arts, Cultural Development and Tourism to enter into and execute a contract with Newark Arts Council for  “2015 Community Arts and Culture Entertainment Series” and entertainment activities and events associated with the Newark Entertainment Series 2015, for an amount not to exceed One Hundred Thirty-One Thousand Five Hundred Dollars and Zero Cents ($131,500.00), for the period commencing on July 1, 2015 and terminating on December 31, 2015.
