WHEREAS, the City of Newark, Department of Health and Community Wellness (“DHCW”) has expended and continues to expend funds to provide Local Health Department (“LHD”) related services during the ongoing COVID-19 Public Health Emergency and pandemic; and 

 

WHEREAS, the New Jersey Association of County and City Health Officials (“NJACCHO”) has made funds available for LHD to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases; and

 

WHEREAS, NJACCHO agrees to reimburse DHCW retroactively, from October 1, 2022 through June 30, 2023, for LHD related expenses and continue such reimbursement until the project period termination of June 30, 2024, in the amount of Three Million Eight Hundred Sixty-Three Thousand Two Dollars and Zero Cents ($3,863,002.00) is reached; and  

 

WHEREAS, the DHCW agrees to submit invoices for COVID-19 and LHD to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases related expenditures, for which the City of Newark seeks reimbursement from NJACCHO; and

 

WHEREAS, NJACCHO agrees to work closely with the DHCW and the New Jersey Department of Health (“NJDOH”) to resolve any payment discrepancies, should they arise, in a timely manner; and

WHEREAS, the DHCW accepts funds from NJACCHO as reimbursement for LHD COVID-19 related expenditures and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases, at no cost to the City of Newark; and

 

WHEREAS, as a condition of reimbursement the DHCW agrees to any modifications to this reimbursement program as may be imposed upon NJAACHO, NJDOH; and

 

WHEREAS, the DHCW shall adhere to NJACCHO deadlines for reimbursement submission(s).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to enter into an agreement and accept reimbursement funds for COVID-19 related expenses and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases from the New Jersey Association of County and City Health Officials (NJACCHO), whose principal place of business is P.O. Box 6987, Freehold, New Jersey 07728, to period commencing October 1, 2022 through June 30, 2023 (“Letter of Agreement”) (a copy of the Letter of Agreement is attached hereto and made a part hereof).

 

2.                     The Municipal Council hereby ratifies this Letter of Agreement from October 1, 2022 to the date of the adoption of this authorizing Resolution.

 

3.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept from NJACCHO an amount of Three Million Eight Hundred Sixty-Three Thousand Two Dollars and Zero Cents ($3,863,002.00). Acceptance of reimbursement funds does not require the expenditure of any municipal funds. 

 

4.                     The Director of the Department of Health and Community Wellness shall file with the Office of the City Clerk a fully executed copy of the Agreement with NACCHO.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness to enter into and execute a Letter of Agreement and accept reimbursement funds from the New Jersey Association of County and City Health Officials (NJACCHO), located at P.O. Box 6987, Freehold, New Jersey 07728, in the amount of up to $3,863,002.00, for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases, for the period commencing on October 1, 2022 through June 30, 2023 and/or until such time the program period termination of June 30, 2024. The acceptance of NJACCHO COVID-19 reimbursement funds does not require the expenditure of any municipal funds.
