WHEREAS, the City of Newark, Department of Engineering, Division of Traffic and Signals, advertised for receipt of bid on April 18 and 25, 2023, for Contract No. 2023-09, All Wards Traffic Calming Program & Pothole Repairs on Various Streets in the City of Newark; and
WHEREAS, on May 3, 2023, two (2) bids were received for Contract No. 2023-09, All Wards Traffic Calming Program & Pothole Repairs on Various Streets in the City of Newark, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, the Acting Director of the Department of Engineering, desires to accept the bid proposal submitted by the lowest responsible bidder, JA Alexander Incorporated, 130-158 John F. Kennedy Drive North, Bloomfield, New Jersey 07003 and execute Contract No. 2023-09, All Wards Traffic Calming Program & Pothole Repairs on Various Streets in the City of Newark, for the total bid amount of $1,340,641.70; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meet the requirements of the Fair and Open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Acting Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, JA Alexander Incorporated, 130-158 John F. Kennedy Drive North, Bloomfield, New Jersey 07003 and to enter into and execute Contract No. 2023-09, All Wards Traffic Calming Program & Pothole Repairs on Various Streets in the City of Newark, for the total bid amount not to exceed One Million Three Hundred Forty Thousand Six Hundred Forty-One Dollars and Seventy Cents ($1,340,641.70).
2. Attached hereto is a Certification of Funds from the Director of Finance of the City of Newark which states, (1) that there are available sufficient legally appropriated funds in the amount of One Million Three Hundred Forty Thousand Six Hundred Forty-One Dollars and Seventy Cents ($1,340,641.70) for the purpose set forth hereinabove, and (2) that the line appropriation of the official budget which shall be charged is as follows:

3. A fully executed copy of this contract and the Certification of Funds shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering.
4. No amendments or modifications to this contract are allowed without prior Municipal Council approval.
5. This contract is to be completed within a period of 365 consecutive calendar days from the issue of a “Notice to Proceed” by the Director of the Department of Engineering.
6. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
STATEMENT
