Resolution 7R3-b adopted on September 20, 2023, awarded Contract #2023-01R PS to H2M Architects and Engineers, Inc., for the modernization of elevators at multiple public buildings within the City of Newark in an amount not to exceed $268,050.00, for a period of 365 consecutive calendar days from the date of the issuance of a formal Notice to Proceed.
This Amending Resolution authorizes changing the funding source to Contract #2023-01R PS with H2M Architects and Engineers, Inc., from the 2023 Budget/Department of Engineering/NW011-200-2001-A-71660-B2023 to the Capital Budget/NW045-23A-23A00-A-94710-B2023.

WHEREAS, Resolution 7R3-b, adopted on September 20, 2023, authorized the Acting Director of the Department of Engineering to accept the proposal submitted by H2M Architects and Engineers Inc., 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054, and execute Contract #2023-01R PS, for the Modernization of Elevators at Multiple Sites, in an amount not to exceed Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00) from the 2023 Budget/Department of Engineering/NW011-200-2001-A-71660-B2023; and
WHEREAS, the original funding source for Contract #2023-01R PS was certified from the 2023 Budget/Department of Engineering/NW011-200-2001-A-71660-B2023 in the amount of Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00), however, these funds have been transferred to the Capital Budget Project fund, NW045-23A-23A00-A-94710-B2023; and
WHEREAS, therefore, the original certification of funds for Contract #2023-01R PS are no longer available from Budget/Department of Engineering/NW011-200-2001-A-71660-B2023; and
WHEREAS, the Acting Director of the Department of Engineering desires to amend the funding source for Contract #2023-01R PS and to certify funds in the amount of Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00) from Capital Budget/NW045-23A-23A00-A-94710-B2023; and
WHEREAS, this contract is for an amount over $17,500.00 and was awarded as a Fair and Open contract pursuant to N.J.S.A. 19:44A-20.5; and
WHEREAS, this award is in compliance with Ordinance 2:4-22C.1, which adopted the State of New Jersey’s Pay-to-Play statutory requirements, pursuant to N.J.S.A. 19:44A-20.5, as may be amended and supplemented, governing eligibility for municipal contracts.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R3-b, adopted on September 20, 2023, is hereby amended to change the funding source for Contract #2023-01R PS with H2M Architects and Engineers, Inc., 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054, for the Modernization of Elevators at Multiple Sites within the City of Newark, to funding source: Capital Budget/NW045-23A-23A00-A-71660-B2023.
2. Attached hereto is a Certification of Funds issued by the City’s Chief Financial Officer, which states that there are available and sufficient legally appropriated funds for the purpose set forth hereinabove. Funds for this contract in the amount of Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00) is provided below.

STATEMENT
This Resolution amends Resolution 7R3-b, adopted on September 20, 2023, by amending the funding source for Contract #2023-01R PS, with H2M Architects and Engineers Inc., 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054, for the Modernization of Elevators at Multiple Sites, in the amount not to exceed $268,050.00, to be funded from the 2023 Capital Budget Project fund.
