WHEREAS, on April 8, 2015, the Department of Engineering, City of Newark, advertised for the receipt of bids for Contract #04-2015 E.C.I.A. 16 Sale-Lease Back Public Buildings - Remediation Work at Five (5) Sites, Newark, New Jersey, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, on April 14, 2015, the four contractors who picked up bid packages for Contract #04-2015 E.C.I.A. 16 Sale-Lease Back Public Buildings - Remediation Work at Five (5) Sites, Newark, New Jersey, were invited to do a visual inspection of the site; and
WHEREAS, on May 5, 2015, scheduled date for the public opening of bids, one (1) bid was received; and
WHEREAS, on May 5, 2015, the contractor was notified by regular mail and email that a re-bid of the project would take place at a later date due to the rejection of the bid for being materially defective;
WHEREAS, on May 11, 2015, the Department of Engineering, City of Newark, advertised for the receipt of sealed bids for Contract #04-2015R, E.C.I.A. 16 Sale-Lease Back Public Buildings - Remediation Work at Five (5) Sites, Newark, New Jersey, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, on June 2, 2015, the advertised, scheduled date for the public opening of bids, four (4) bids were received; and
WHEREAS, GZA GeoEnviromental, Inc., the consultant retained by the City of Newark, recommends that the contract be awarded to Yannuzzi Group, Inc., 135 Kinnelon Road, Suite 102, Kinnelon, New Jersey 07405, the lowest responsible bidder; and
WHEREAS, the Director of the Department of Engineering has determined that it is in the best interest of the City of Newark to accept the bid proposal and execute Contract #04-2015R E.C.I.A. 16 Sale-Lease Back Public Buildings - Remediation Work at five (5) Sites, Newark, New Jersey, with the lowest responsible bidder, Yannuzzi Group, Inc., 135 Kinnelon Road, Suite 102, Kinnelon, New Jersey 07405, in the total bid amount of $805,075.00 (Base Bid for $510,075.00 + Allowance $75,000.00 + Item #3 $220,000.00 for a Total Amount of $805,075.00); and
WHEREAS, some of the major items of work covered by this contract are (i) furnishing all labor, equipment, transportation, materials, and insurance, to complete restoration of all landscaped areas disturbed during the Work. Work shall include the supplying and spreading of topsoil where needed, all construction of all plant material subject to approval by the Owner’s Representative or Engineer, (ii) labor and equipment required to place, amend, and fine grade the soil, (iii) responsible for obtaining all necessary permits and soil tests; and
WHEREAS, the public advertisement and the receipt of public bids and the award of the contract to the lowest responsible bidder, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq. constitutes a fair and open process pursuant to the Local Pay to Play Law, N.J.S.A. 19:44A:20.5, et seq.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee the Director of the Department of Engineering is hereby authorized to accept the bid submitted by the lowest responsible bidder Yannuzzi Group, Inc., 135 Kinnelon Road, Suite 102, Kinnelon, New Jersey 07405, and execute Contract #04-2015R E.C.I.A. 16 Sale-Lease Back Public Buildings - Remediation Work at Five (5) Sites, Newark, New Jersey, with them, for the total bid amount of $805,075.00 (Base Bid for $510,075.00 + Allowance $75,000.00 + Item #3 $220,000.00 for a Total Amount of $805,075.00).
2. Funds for this contract in the amount of $805,075.00 shall be provided by the Essex County Improvement Authority (“ECIA”) through the Bank of New York Mellon and payments made for this project shall be monitored by the City of Newark, Department of Finance.
3. This contract is being awarded pursuant to the fair and open procedures of the Pay to Play Law, N.J.S.A. 19:44A-20.5, et seq. and in accordance with the public bid procedures pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.
4. No changes to this contract shall be allowed or authorized without prior Municipal Council approval.
5. There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
6. A fully executed copy of the contract shall be filed in the Office of the City Clerk, by the Director of Engineering or his designee.
7. The term of this contract shall be one (1) year from the date of the Notice to Proceed issued by the Director of Engineering or his designee.
8. A notice of this action shall be printed in a local newspaper as required by law within ten (10) days hereof.
