WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $205,265.00 bringing the total program resources to $965,265.00 for the continued provision of Traffic Signal Optimization/Adaptive Traffic Signals Along McCarter Highway (Route 21) Project and no provision has been made in the 2017 Temporary Budget for the aforesaid purpose; and
WHEREAS, N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the aforementioned purpose; and
WHEREAS, by Resolution 7R3-a dated April 19, 2017, the City of Newark accepted from North Jersey Transportation Planning Authority (NJTPA) in the amount of $205,265.00 for Traffic Signal Optimization/Adaptive Traffic Signals along McCarter Highway (Route 21) Project. A local match of $46,502.00 will be required for receipt and acceptance of this grant award and shall be provided from the 2017 Municipal Budget, for a project total of $251,767.00. Traffic Signal Optimization/Adaptive Traffic Signals Along McCarter Highway Grant (Route 21) Project commencing on July 1, 2016 and terminating upon Project completion; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2016, pursuant to N.J.S.A. 40A:4-20 including this resolution total...$ 230,331,702.18
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. An emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2017 budget.
3. A copy of this resolution shall be immediately filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This resolution establishes the additional temporary emergency appropriation in the amount of $205,265.00 for the Traffic Signal Optimization/Adaptive Traffic Signals along McCarter Highway (Route 21) Project. A local match of $46,502.00 shall be provided from the 2017 Municipal Budget, which brings the Project total to $1,201,767.00. The contract period commences on July 1, 2016 and terminates upon Project completion. Funding has been provided by the North Jersey Transportation Planning Authority (NJTPA) and 2017 Matching Municipal funds. (East Ward).
