WHEREAS, the City of Newark Department of Public Safety, Police Division (“City” or “Licensee”), desires to enter into a License Agreement with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112 (“Site”) (“Licensor”) to install, operate and maintain communications equipment, including but not limited to antennas, cables, connectors, wires, radio shelter and related transmission and reception hardware and software (“Equipment”) for the City’s new Radio System; and

 

WHEREAS, pursuant to the License Agreement the Licensor shall allow the City to utilize a portion of the Site, comprising of approximately 1150 square feet located on the 13th floor of the D Tower and approximately 30 square feet located on the roof of the D Tower; and

 

WHEREAS,  the new Radio System will allow for enhanced coverage city-wide, to support the Police Department, the Fire Department and other City Agencies and will allow for a more secure encrypted radio transmission; and

 

WHEREAS, the Newark Municipal Council finds it in the City’s best interest to enter into the License Agreement with Licensor.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, and the Director of the Department of Public Safety, are hereby authorized to enter into and execute a License Agreement, in the form attached hereto, with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey  07112(“Site”)(“Licensor”), to utilize a portion of the Site, comprising of approximately 1150 square feet located on the 13th floor of the D Tower and approximately 30 square feet located on the roof of the D Tower for the installation of communications equipment including but not limited to Licensee’s antennas, cables, connectors, wires, radios, radio shelter or cabinet, and related transmission and reception hardware and software, for the City’s new radio system.

 

2.                     The initial term of this License Agreement begins January 1, 2024 for a period of three (3) years, ending on December 31, 2026, which shall automatically extend for up to five (5) additional renewal period(s) of one (1) year(s) each thereafter unless, either the City of Newark or Licensor provides written notice of its election not to renew.

 

3.                     This Agreement shall be at no cost to the City of Newark.

 

4.                     The Municipal Council hereby ratifies its authorization of the execution of the License Agreement from January 1, 2024 through the date of the adoption of this authorizing Resolution.

5.                     A copy of the executed License Agreement shall be filed in the Office of the City Clerk by the Director of the Department of Public Safety and shall be made available for public inspection.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Public Safety, to enter into and execute a License Agreement with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112 to for the installation, operation and maintenance of communications equipment beginning January 1, 2024 through December 31, 2026 with five (5) automatic renewals of one (1) year each at no cost to the City.
