WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) Board of Trustees is working with the Federal Highway Administration (FHWA), New Jersey Department of Transportation (NJDOT), subregions and other state and local agencies to make travel a safer and more reliable experience within its region utilizing the Local Safety Program; and

WHEREAS, on July 26, 2019, the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit an application for the FY 2020 solicitation of the Local Safety and High Risk Rural Roads Program; and

WHEREAS, on January 10, 2020, the City of Newark, Department of Engineering, submitted an application to the NJDOT requesting grant funding in the amount of $4,200,000.00 from the NJTPA FY 2020 Local Safety High Risk Rural Roads Program for the City's Bergen Street Pedestrian Safety Corridor Improvements project, with no City funds required; and

WHEREAS, on February 11, 2021 NJTPA notified the City of Newark that the City NJTPA Board of Trustees approved the Bergen Street Pedestrian Safety Corridor Improvements project for funding through the FY 2020 Local Safety High Risk Rural Roads Program; and

WHEREAS, upon notification of the receipt of the final grant funding award in connection with the NJTPA's February 11, 2021 letter, the Director of the Department of Engineering desires to accept the grant award and execute a grant/project agreement with the NJDOT and the NJTPA governing said award; and

WHEREAS, upon notification of receipt of final authorization of this project from NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an application to the New Jersey Department of Transportation (NJDOT), on behalf of the City of Newark, requesting grant funding in the amount of $4,200,000.00 from the North Jersey Transportation Planning Authority (NJTPA) FY 2020 Local Safety High Risk Rural Roads Program, for the City's Bergen Street Pedestrian Safety Corridor Improvements project, with no City funds required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application to the NJDOT for the NJTPA FY 2020 Local Safety High Risk Rural Roads Program from the date of application submission to the date of adoption of this authorizing Resolution.

3. Upon notification of the receipt of a final grant award in connection with this application, the grant is hereby accepted.

4. Upon notification of the receipt of a final approval of a grant award in connection with this application, the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT and the NJTPA to receive and expend the final grant award from FY 2020 Local Safety High Risk Rural Roads Program for the City's Bergen Street Pedestrian Safety Corridor Improvements project.

5. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Director of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.


STATEMENT

This Resolution ratifies and authorizes the actions taken by the City of Newark, Department of Engineering, to submit the FY 2020-Local Safety High Risk Rural Roads Program application for grant funding from the New Jersey Department of Transportation (NJDOT), for the Bergen Street Pedestrian Safety Corridor Improvements Phase II and furthermore, ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept all grant funds from the North Jersey Transportation Planning Authority (NJTPA) and NJDOT, for the Bergen Street Pedestrian Safety Corridor Improvements Phase II. No municipal funds are required for receipt or acceptance of this grant award.
