WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division Local Government Services may approve the insertion of any Special Item of Revenue in the budget of any local unit when such item shall have been made available by law and the amount thereof shall not have been determined at the time of the adoption of the budget, and may approve the insertion of an appropriation item of equal amount for the purpose of carrying out the purposes of the law making such item of revenue available for expenditure; and
WHEREAS, the New Jersey Department of Environmental Protection (“NJDEP”) Green Acres Program (“Green Acres Program”) Program has made available funds in the amount of Three Million Eight Hundred Thousand Dollars and Zero Cents ($3,800,000.00), for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, the City of Newark received and deposited funds from the State of New Jersey, Department of Environmental Protection, Green Acres Program and Office of the Natural Resource Restoration, the City was awarded a grant in the amount of Three Million Eight Hundred Thousand Dollars and Zero Cents ($3,800,000.00), to redevelop the area known as Jesse Allen Park, a City-owned park located in the Central Ward (“Jesse Allen Park” or “Project”) in three (3) phases, for the benefit of the City of the Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. In accordance with the provisions of N.J.S.A. 40A: 4-87, the City of Newark, New Jersey hereby requests the Director of Local Government Services to approve a budget insertion in the amount of Three Million Eight Hundred Thousand Dollars and Zero Cents ($3,800,000.00), and an appropriation of an equal amount for the FY 2023 NJDEP for the development of Jesse Allen Park Project, in the budget year 2023 as set forth in Schedule A, attached hereto and made a part hereof.
2. The aforesaid insertion is, in the opinion of the Governing Body, warranted and authorized by N.J.S.A. 40A:4-87 and are necessary for the orderly operation of the municipality.
3. A copy of this Resolution shall be filed with the Director of the Division of Local Government Services by the City Clerk.
STATEMENT
This Resolution is establishing an appropriation and revenue in the FY 2023 Municipal Budget in the amount of Three Million Eight Hundred Thousand Dollars and Zero Cents ($3,800,000.00), for the FY 2023 NJDEP for the development of Jesse Allen Park Project. The State of New Jersey, Department of Environmental Protection, Green Acres Program and Office of the Natural Resource Restoration, is providing these funds. The project period is upon completion.
