WHEREAS, pursuant to a fair and open process Resolution 7R12-a adopted on December 18, 2024, authorized the Director of the Department of Water and Sewer Utilities, to enter into and execute a contract with Arcadis U.S., Inc., 630 Plaza Drive, Suite 200, Highlands Ranch, Colorado 80129, to provide Professional Engineering Services on an As-Needed Basis, in an amount not to exceed $100,000.00 and for a contract period from January 1, 2025 through December 31, 2025, and when applicable to extend beyond, as authorized by N.J.S.A. 40A:11-15(9) for the duration of the Project; and
WHEREAS, the Department of Water and Sewer Utilities received a request for Contract Amendment dated September 10, 2025 detailing various tasks in progress which total in the amount of $32,106.00 ($32,106.00 overbudget), with an additional $67,894.00 requested to fully complete the ongoing tasks, including construction administration of the Cedar Grove Stormwater Mitigation Improvement project; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Amendment No. 1 for an increase of the contract amount by $100,000.00 with Arcadis U.S., Inc., to continue providing Professional Engineering Services on an As-Needed Basis to cover the cost of Various Tasks, as more fully set forth in the scope of the services detailed in the attached proposal letter dated September 10, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Major and/or his Designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Amendment No.1 with Arcadis U.S., Inc., 630 Plaza Drive, Suite 200, Highlands Ranch, Colorado 80129, to continue to provide Professional Engineering Services for ongoing projects including construction administration of the Cedar Grove Stormwater Mitigation Improvement project for an additional $100,000.00 for a total contract amount not to exceed $200,000.00.
2. Pursuant to N.J.A.C. 5:30-5.5(a), Temporary Budget, attached hereto is a partial Certification of Funds issued by the Director of the Department of Finance, which state that there are available sufficient legally appropriated funds in the amount of $5,000.00 for the purposes set forth herein, under NW037-750-7502-71240-B2025 the certification shall be filed along with the original resolution in the Office of the City Clerk. The remainder of the funding for this contract will be subject to appropriation in the 2025 Budget and funds will be certified prior to services being provided by the contractor.
3. The Director of the Department of Water and Sewer Utilities shall file a duly executed copy of the Amendment No. 1 to the Agreement in the Office of the City Clerk.
4. All other Terms and Conditions of the contract remain the same.
5. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this resolution.
