This resolution authorizes the City’s Department of Health and Community Wellness to utilize MMCAP Infuse, a national cooperative purchasing program to purchase primary care, dental care, women services, mental health care, pharmaceuticals, vaccines, and medical and dental supplies or equipment.

WHEREAS, on March 1, 2023, the Municipal Council of the City of Newark (“City”) adopted Resolution 7R1-f authorizing the City’s membership in the Minnesota Multistate Contracting Alliance for Pharmacy, 50 Sherburne Avenue Suite 112, St. Paul, Minnesota 55155 (“MMCAP Infuse”), a national cooperative purchasing program; and
WHEREAS, MMCAP Infuse maintains competitively awarded master contracts through which its members can make advantageous purchases; and
WHEREAS, said cooperative purchasing program was developed for the purpose of utilizing the competitive bidding process to make public procurement more efficient and provide cost savings to its members; and
WHEREAS, the Department of Health and Community Wellness (“HCW”) has requested to utilize MMCAP Infuse to purchase from authorized vendors Cardinal Health Inc. 7000 Cardinal Place, Dublin, Ohio 43017 and Dental Health Products, Inc., 2641 North Sugar Bush Road, New Franken, Wisconsin 54229 pharmaceuticals, vaccines, medical and dental supplies/equipment at a contract amount not to exceed One Million Five Hundred Thousand Dollars and Zero Cents ($1,500,000.00); and
WHEREAS, as indicated in the attached Cost Savings Determination, HCW has determined the use of MMCAP Infuse contracts MMS2401062 and MMS2401075 would result in cost savings after all factors, including charges for service, materials and delivery, have been considered; and
WHEREAS, HCW will purchase the necessary vaccines, pharmaceuticals and medical equipment and supplies from Cardinal Health, Inc. and Dental Health Products, Inc. pursuant to a Federally approved program for uninsured Newark residents; and
WHEREAS, on November 25, 2025 the Division of Central Purchasing published a Notice of Intent to purchase pharmaceuticals, medical and dental supplies and equipment under a national cooperative purchasing agreement, which HCW will use to better able serve the residents (attached hereto).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designees, the Qualified Purchasing Agent, QPA and/or the Business Administrator are hereby authorized to utilize Minnesota Multistate Contract Alliance for Pharmaceuticals (“MMCAP Infuse”) contracts MMS2401062 and MMS2401075 to purchase pharmaceuticals, vaccines, and medical and dental supplies and equipment from the following authorized vendors: Cardinal Health Inc., 7000 Cardinal Place, Dublin, Ohio 43017 and Dental Health Products, Inc., 2641 North Sugar Bush Road, New Franken, Wisconsin 54229.
2. The Purchasing Agent shall insure that all purchases made utilizing MMCAP Infuse comply with to the New Jersey Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.). All purchases, purchase orders and other related documents shall be in accordance with the relevant MMCAP Infuse specifications, including, where applicable, standard terms and conditions, method of operation, and third-party agreements as provided in the cooperative contract documents.
3. There shall be no amendments of this resolution without the approval of the Municipal Council.
4. There shall be no advance payment on this Cooperative Contract in accordance with N.J.S.A. 40A:5-16
5. These are open-ended contracts to be used as needed during the term of the contracts. Thus, for any and all expenditures against these contracts, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(d)(2), shall be executed before a contractual liability is incurred each time an order is placed, covering the amount of the order from the following account code line: Department of Health and Community Wellness NW026-46540-B2025. These contracts shall not exceed One Million Five Hundred Thousand Dollars and Zero Cents ($1,500,000.00).
6. These contracts were awarded pursuant to a fair and open process within the meaning of the New Jersey Local Unit Pay-to-Play Law (N.J.S.A. 19:44A-20.4 et seq.).
7. The Division of Central Purchasing shall file a duly executed copy of the contracts in the Office of the City Clerk, if applicable.
8. If required by state law, the City Clerk shall provide the appropriate Notice of Award of this contracts to the State Comptroller no later than twenty (20) business days following such award in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designees, the Qualified Purchasing Agent, QPA and/or the Business Administrator, to utilize MMCAP Infuse Contracts MMS2401062 Cardinal Health Inc. 7000 Cardinal Place, Dublin, OH 43017 and MMS2401075 Dental Health Products, Inc., 2641 North Sugar Bush Road, New Franken, WI 54229 to purchase pharmaceuticals, vaccines, medical and dental supplies/equipment from their Cooperative Purchasing Program at a cost not to exceed One Million Five Hundred Thousand Dollars and Zero Cents ($1,500,000.00). The purchases will to be utilized by the Department of Health and Community Wellness to serve the residents of Newark for the period commencing upon approval of this resolution by Municipal Council through expiration of respective contract, inclusive of any extensions granted by MMCAP Infuse.
