WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) 2021 Safe Streets to Transit Program (SST Program), provides grant funding for infrastructure improvements for traditional and non-traditional transportation initiatives that enable and encourage walking and bicycling to transit; and
WHEREAS, on July 6, 2020, on behalf of the City of Newark, the Director of the Department of Engineering submitted an electronic grant application to NJDOT requesting grant funding in the amount of Three Hundred Ninety-Three Thousand Dollars and Zero Cents ($393,000.00), from the New Jersey Department of Transportation’s 2021 SST Program, to improve the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue, with no City funds required; and
WHEREAS, on February 4, 2021, NJDOT announced that the City was selected to receive a grant award in the amount of Three Hundred Thousand Dollars and Zero Cents ($300,000.00), for the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue, with no City funds required; and
WHEREAS, NJDOT requires the City to award the contract for the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue, with no City funds required, within twenty-four (24) months of the announcement of the receipt of a grant award, with a final deadline of February 4, 2023; and
WHEREAS, due to the discovered utility conflict, the final approval of the project has been delayed; and
WHEREAS, the City of Newark wishes to request that the NJDOT allow the City of Newark to award the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue, by August 4th 2023.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request an extension of the deadline from the New Jersey Department of Transportation (NJDOT) from February 4, 2023 to August 4th, 2023, to allow the City of Newark to award a contract for the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue.
2. All other terms and conditions of the grant award from the NJDOT for the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue shall remain in force and effect until the contract is completed.
3. The Municipal Council hereby ratifies its authorization of this extension request from the date of the extension request submission to NJDOT to the date of adoption of this authorizing resolution.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to request an extension from NJDOT to allow the City of Newark to award a contract for the construction of infrastructure improvements at the intersection at Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue, by August 4, 2023. No municipal funds are required.
