      Whereas, the City of Newark is in need of Staffing of Temporary In-Bound Call Center Customer Service Representatives to assist the City's efforts in maintaining non-emergency call center services at Newark 4311; and       
 
                Whereas, a fair and open bidding process along with prepared legislation for the award of a contract to the lowest responsible bidder is pending; and
 
      Whereas, in the absence of a contract for temporary staffing of the non-emergency call center, the Office of the Business Administrator, on July 1, 2013, as authorized by N.J.S.A. 40A:11-6, N.J.A.C. 5:34-6.1 and City Ordinance 6PSF-e April 6, 2011 Article 2:5-13.2 (E)(1) declared an emergency regarding the staffing of the non-emergency call center and awarded an emergency contract to Sharpened Image, LLC., 2004 Morris Avenue, Suite. 1, Union, New Jersey, 07083, which authorization expired September 30, 2014 pursuant to City Ordinance; and
 
      Whereas, the continued temporary staffing of the non-emergency call center will facilitate the intake, cataloguing, dispatch, record keeping, and reporting of constituent concerns, questions, and service requests; and
 
      Whereas, the uninterrupted operations of the non-emergency call center are crucial to the unhindered operations of emergency operations that may arise throughout the City; and
 
      Whereas, the cost for temporary staffing of the non-emergency call center shall not exceed $90,000.00 for the period beginning October 1, 2013 and for such limited duration as meets the needs of the emergency but not extend beyond June 30, 2014; and
 
       Whereas, pursuant to N.J.A.C. 5:34-6.1, the City is in need of an extension of the existing emergency contract for the temporary staffing of the non-emergency call center in order to continue services uninterrupted; and
 
      Whereas, the extension of the emergency contract shall be of such limited duration as to meet only the immediate needs of the emergency N.J.A.C. 5:34-6.1(a)(4) and under no circumstances shall the emergency purchasing procedure extend beyond June 30, 2014, N.J.A.C. 5:34-6.1(a)(5); and
 
      Whereas, City Ordinance 6PSF-e April 6, 2011 Article 2:5-13.2 (E) (1) (b), (c) states that emergency contracts shall not be for a period in excess of ninety (90) days and no extensions of an emergency contract shall be permitted without the authorization by the Municipal Council by resolution.                                                
 
      NOW, THEREFORE , BE IT RESOLVED BY THE MUNICIAPL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and /or his designee, the Business Administrator are authorized to extend the existing emergency contract with Sharpened Image, LLC., 2004 Morris Ave, Suite. 1, Union, New Jersey 07083, for the temporary staffing of the non-emergency call center commencing October 1, 2013, for such limited duration as meets the needs of the emergency but shall not extend beyond June 30, 2014 under any circumstances.  .
 
2.      This extension will allow the continuity of Emergency Contract E2013-05, that commenced on July 1, 2013 and ended on September 30, 2013.
 
3.      The contract extension is ratified from October 1, 2013, to the date of adoption of this resolution.
 
4.      Attached hereto is a Certification of Funds which shows that there are sufficient funds for the purposes set forth herein above.
 
5.      An executed copy of said contract shall be filed with the Office of the City Clerk by the Business Administrator for the City of Newark.
 
6.      The total amount of contract extension shall not exceed $90,000.00.
 
 
Statement
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to extend the emergency contract with Sharpened Image, LLC, 2004 Morris Ave, Suite. 1, Union, New Jersey 07083, to provide temporary staffing of the non-emergency call center from October 1, 2013 for such limited duration as meets the needs of the emergency but shall not extend beyond June 30, 2014, under any circumstances, for an amount not to exceed $90,000.00.
