AN ORDINANCE AMENDING TITLE XXIII, TRAFFIC, CHAPTER 5, PARKING, STOPPING AND STANDING, GENERALLY, SECTION 23:5-1, PARKING PROHIBITED AT ALL TIMES, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY ADDING THE WEST SIDE OF FABYAN PLACE BETWEEN NYE AVENUE AND LYONS AVENUE, AND THE EAST SIDE OF FABYAN PLACE BETWEEN SHAW AVENUE AND LYONS AVENUE (SOUTH WARD).

WHEREAS, the Acting Director of Engineering desires to revise Section 23:5-1, Parking Prohibited at all Times, of Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, of the Revised General Ordinances of the City of Newark, by adding No Parking Anytime restrictions on the west side of Fabyan Place between Nye Avenue and Lyons Avenue and on the east side of Fabyan Place between Shaw Avenue and Lyons Avenue (South Ward); and
WHEREAS, the Acting Director of the Department of Engineering desires to improve safety on the west side of Fabyan Place between Nye Avenue and Lyons Avenue and on the east side of Fabyan Place between Shaw Avenue and Lyons Avenue (South Ward), by adding “No Parking Anytime” prohibitions at those locations.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
SECTION 1. Title XXIII, Traffic, Chapter 5, Parking, Stopping and Stnding, Generally, Section 23:5-1, Parking Prohibited at all Times, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, be amended and supplemented by adding the following:
Fabyan Place, West Side, between Nye Avenue and Lyons Avenue
Fabyan Place, East Side, between Shaw Avenue and Lyons Avenue
SECTION 2. Regulatory signs shall be erected and maintained by the City of Newark.
SECTION 3. Any Ordinance or parts thereof inconsistent with this ordinance are hereby repealed.
SECTION 4. This Ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.
SECTION 5. This Ordinance does not require approval by the Commissioner of Transportation.
SECTION 6. Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.
STATEMENT
This Ordinance amends Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, Section 23:5-1, Parking Prohibited at all Times by adding “No Parking Anytime” prohibitions on the west side of Fabyan Place between Nye Avenue and Lyons Avenue and on the east side of Fabyan Place from Shaw Avenue to Lyons Avenue (South Ward).
