WHEREAS, Resolution 7R1-s adopted on July 13, 2022, by the Municipal Council authorized the Purchasing Agent, QPA, to enter into and execute a contract with Dhall Hospitality Group, LLC., 24 Oak Drive, Syosset, New York 11791 (“Contractor”) to provide Healthy Nutritional Meals to Newark Senior Citizens in the amount of Four Hundred Twenty Thousand Dollars and Zero Cents ($420,000.00) for a period not to exceed twenty-four (24) consecutive months pursuant to .N.J.S.J.40A 11-15; and
WHEREAS, the Healthy Nutritional Meals to Newark Senior Citizens (“program”), as currently formulated, has failed to meet the City’s anticipated needs; and
WHEREAS, the City desires to study the possibility of revising the program’s specifications to better satisfy the goal of providing nutritional meals to seniors; and
WHEREAS, pursuant to the terms of the award, specifically section 3.38(H)- Termination of Contract, the City of Newark wishes to terminate the contract for convenience by providing sixty (60) calendar days advanced notice to the contractor; and
WHEREAS, accordingly, the QPA issued Notice to Terminate to the Contractor on June 9, 2023 (“Notice”); which Notice is attached and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-d adopted on July 13, 2022 by Municipal Council awarding a contract to Dhall Hospitality Group, LLC., 24 Oak Drive, Syosset, New York 11791 (“Contractor”), in an amount not to exceed Four Hundred Twenty Thousand Dollars and Zero Cents ( $420,000.00) for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15, is hereby rescinded and the Contract with the Contractor is null and void
STATEMENT
This Resolution rescinds Resolution 7R1-s adopted on July 13, 2022, for the award of a contract to Dhall Hospitality Group, LLC., 24 Oak Drive, Syosset, New York 11791 to provide healthy nutritious meals to Newark Senior Citizens for the Department of Recreation, Cultural Affairs and Senior Services, in an amount not to exceed Four Hundred Twenty Thousand Dollars and Zero Cents ($420,000.00) for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15, due to the City’s desire to terminate the contract for convenience.
