The 1st Extension of Emergency Contract #E2020-24 was adopted as 7R1-b (S/AS) on March 23, 2021 in an amount not to exceed $83,475.70 for the period of March 16, 2021 through June 16, 2021.
The 2nd Extension of Emergency Contract #E2020-24 was adopted as 7R1-c(S/AS) on June 22, 2021 in an amount not to exceed $166,750.00 for the period of June 17, 2021 through December 31, 2021.
The 3rd Extension of Emergency Contract #E2020-24 was adopted as 7R1-I(AS) on May 4, 2022 in an amount not to exceed $166,750.00 for the period of January 1, 2022 through June 30, 2022.
The 4th Extension of Emergency Contract #E2020-24 is for an additional 180 days in an amount not to exceed $166,750.00 for the period of July 1, 2022 through January 31, 2023.
This 5th Extension of Emergency Contract #E2020-24 is for an additional 180 days in an amount not to exceed $166,750.00 for the period of February 1, 2023 through August 31, 2023.

WHEREAS, on December 15, 2020 the Department of Administration requested a declaration of emergency to construct temporary shelter containers and provide shelter operation services during Code Blue and COVID-19 pandemic, for the health, safety, and welfare of the residents of the City of Newark: and
WHEREAS, on December 16, 2020 the Qualified Purchasing Agent, QPA, declared the requested emergency and awarded an Emergency Contract for the period of December 15, 2020 through March 15, 2021 in the amount of Six Hundred Thirty-Three Thousand Three Hundred Seventy-Five Dollars and Zero Cents ($633,375.00) to Home 4 the Homeless 3362 Fulton Road Fulton, CA 95439 and United Community Corporation 332 South 8th Street Newark, NJ 07103. (A copy of Emergency Contract # E-2020-24 is attached hereto and made a part of this resolution); and
WHEREAS, a first Extension of Emergency Contract #E2020-24 was adopted as 7R1-b (s/a) on March 23, 2021 in an amount not to exceed $83,475.70 for the period of March 16, 2021 through June 16, 2021; and
WHEREAS, a second Extension of Emergency Contract #E2020-24 was adopted as 7R1-c(s/as) on June 22, 2021 in an amount not to exceed $166,750.00 for the period of June 17, 2021 through December 31, 2021; and
WHEREAS, a third Extension of Emergency Contract #E2020-24 was adopted as 7R1-l(as) on May 4, 2022 in an amount not to exceed $166,750.00 for the period of January 1, 2022 through June 30, 2022; and
WHEREAS, a fourth Extension of Emergency Contract #E2020-24 was adopted as 7R1-l(as) on July 1, 2022 in an amount not to exceed $166,750.00 for the period of July 1, 2022 through January 31, 2023; and
WHEREAS, the Department of Administration is in immediate and emergent need for the vendor, United Community Corporation, 332 South 8th Street Newark, New Jersey 07103 to continue to provide temporary shelter services during Code Blue and the COVID-19 pandemic for the health, safety and welfare of the residents in the City of Newark, commencing from the period of February 1, 2023 and continuing through August 31, 2023 or until the emergency is abated or services are performed pursuant to a fully executed contract; and
WHEREAS, N.J.S.A. 40A:11-6 provides that Emergency Contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and
WHEREAS, N.J.A.C. 5:34-6.1(a)3 provides that the emergency purchasing procedure may be used when the need for such goods or services has arisen notwithstanding a good faith effort on the part of a municipality to plan for the purchase of any goods or services required by the municipality; and
WHEREAS, the Department of Administration has assured the Division of Central Purchasing that it has developed specifications to enable the issuance of an RFP to solicit for these operation of shelter services; and
WHEREAS, the Department of Administration has represented to the QPA that the vendor, United Community Corporation 332 South 8th Street Newark, NJ 07103 has continued to provide the necessary and required services and that cessation of the services would pose an imminent harm to the health, safety and welfare of the residents and/or cause the need for a new emergency declaration; and
WHEREAS, the Department of Administration, Office of Homeless Services, the Homelessness Czar desires to ratify and extend Emergency Contract #E2020-24 for an additional 180 days for the period commencing on February 1, 2023 through August 31, 2023, and continuing until the City executes a contract or the emergency is abated, for a total amount not to exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00) to prevent interruption of temporary shelter services during Code Blue and COVID-19 pandemic for the health, safety and welfare the individuals in the City of Newark; and
WHEREAS, the Municipal Council has the exclusive authority to extend an emergency; and
WHEREAS, the services of United Community Corporation 332 South 8th Street Newark, New Jersey 07103 are essential to the continued protection of the health, safety and welfare of the residents of the City of Newark; and
WHEREAS, it is a matter of public health, safety and welfare that the above-described emergency contract be extended because the City of Newark still needs to ensure the safe and uninterrupted services for its residents that need provide housing and protection for the unsheltered population during Code Blue and COVID-19 pandemic; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b)(c) limits the period of Emergency Contracts to ninety (90) days and no extensions of Emergency Contracts shall be permitted without authorization by the Municipal Council by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, are authorized to extend Emergency Contract #E2020-24 with United Community Corporation 332 South 8th Street Newark, New Jersey 07103 for the term of February 1, 2023 through August 31, 2023, for a total amount not to exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00).
2. This extension will allow for the continuation of shelter operation services of the temporary container shelters in the City of Newark.
3. The extension of Emergency Contract #E2020-24 is ratified from February 1, 2023 to the date of adoption of this authorizing resolution.
4. For any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred. Attached hereto is a Certification of Funds in an amount not to exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00) from the Director of Finance and the line appropriation of the Official Budget which shall be charged is Business 051-G22-ARP2C-71280-B2022.
5. The Qualified Purchasing Agent, for the City of Newark, has filed a copy of Emergency Contract #E2020-24, attached hereto, with the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to extend Emergency Contract # E2020-24 with United Community Corporation, 332 South 8th Street Newark, New Jersey 07103, to continue to provide shelter operation services during Code Blue and COVID-19 pandemic for the temporary container shelters at Hope Village 1, located at 79 Newark Street, Newark, New Jersey, for the term of February 1, 2023 through August 31, 2023, or until the emergency is abated or services are performed pursuant to a fully executed contract for a total amount not to exceed One Hundred Sixty Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00).
