WHEREAS, on November 2, 2021, the City of Newark, Department of Engineering, Division of Traffic and Signals (the “City”), advertised for receipt of bids, for Contract #2021-06, Pavement Markings in the City of Newark, New Jersey; and
WHEREAS, on November 16, 2021, the Department of Engineering received three (3) bids for Contract #2021-06, Pavement Markings in the City of Newark, New Jersey, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering, desires to award Contract #2021-06, Pavement Markings in the City of Newark, New Jersey, to the lowest bidder, Denville Line Painting, Incorporated, 2 Green Pond Road, Rockaway, New Jersey 07866, for the total bid amount of Two Hundred Sixty-Seven Thousand Five Hundred Seventy-Five Dollars and Zero Cents ($267,575.00).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark, to accept the bid proposal submitted by the lowest responsible bidder, Denville Line Painting, Incorporated, 2 Green Pond Road, Rockaway, New Jersey 07866, and enter into and execute Contract #2021-06, Pavement Markings in the City of Newark, New Jersey, for the total bid amount of Two Hundred Sixty-Seven Thousand Five Hundred Seventy-Five Dollars and Zero Cents ($267,575.00).
2. Attached is a Certification of Funds from the Director of the Department of Finance, which states: (1) that there are available sufficient legally appropriated funds in the amount of Two Hundred Sixty-Seven Thousand Five Hundred Seventy-Five Dollars and Zero Cents ($267,575.00) for the purpose set forth hereinabove; and (2) that the line appropriation of the official budget which shall be charged is as follows:

3. A fully executed copy of this contract and the Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
4. No amendments or modifications to this contract will be made without Municipal Council approval.
5. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
6. This contract is to be completed within a period of (365) consecutive calendar days from the date of the issuance of a formal written Notice to Proceed by the Director of the Department of Engineering. A copy of the Notice to Proceed shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
7. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, Denville Line Painting, Incorporated, 2 Green Pond Road, Rockaway, New Jersey 07866, and enter into and execute Contract #2021-06, Pavement Markings in the City of Newark, New Jersey, for the total bid amount not to exceed $267,575.00. This contract is to be completed within a period of (365) consecutive calendar days from the date of the issuance of a formal written Notice to Proceed by the Director of the Department of Engineering.
